Solicitor enquiries and HM Land Registry

Hi everyone,

I'm being impatient and was wondering if anyone knows what these enquiries from our solicitors to our vendors actually mean (i.e are they likely to delay things!)

  1. Please see the attached mapsearch which differs from the title plan significantly. Kindly ask HM Land Registry to account for the difference.
  2. Please have the seller's confirm the postcode for the avoidance of any doubt and then apply to HM Land Registry to update the property description

How long will it take HM Land Registry to do these things??

Reads like it's unclear which part of the land/plot is within the boundary as the two sources are conflicting.

There was an 15 month backlog recently in updating the titles but I think they'll expedite for a sale. I'd expect a few months.

You can raise a question on the land registry page (you need to register) they will expedite it if it’s related to a sale. Be prepared to do all the leg work though. They are very responsive on the page.

When we spoke to Land registry on the phone they did say that if it is holding a sale or mortgage etc up then it could be expedited, so hopefully they can do this for you.

Just getting my name changed took 11months.

Currently waiting for the land registry to register a property, should be November next year!!! However if it's a house sale they should move quicker

Thanks everyone. The property is already registered but it is this mismatch between mapsearch and the title plan. We've checked the title plan and it looks correct (it's a circa. 1900 property), apparently it's the mapsearch that looks wrong? No idea how important that is?

It is important that the title plan matches the mapsearch. Your solicitor is unlikely to agree to exchange and set a completion date until this is sorted out.

There will be some back and forth while your solicitor queries the reason for the difference and they will expect the vendor's solicitor to deal with the issue and liaise with the Land Registry and vendor to address the problem. It could take a couple of months, unless there is evidence/paperwork to explain why there is a mismatch and it is easily resolved.

Don't count on being in by Christmas, unfortunately.

Thanks to everyone who replied. Someone kindly recommended that I go onto the land registry website where my query was answered by someone who works there. Apparently the Mapsearch does not need to match the title plan. It is only the title plan that is a legal document that needs to be agreed, which we have.

It's your solicitors job to apply to HMLR not yours, it sounds like they're asking you to do that?

No they're doing it - I'm just looking into it as I wanted to know if it was going to be a major deal!
