Marketing fee's from estate agent

Coukd someone look at our contract. We signed on 30th jan 2024, went on market, had 4 viewings. Accepted offer but buyer pulled out on 5th july.

We said to take off the market as we just couldn't face starting the process again at that point.

Mid August I emailed them to put us back on the market. No response so emailed again a week later. I had nothing back from them until the end of September! By this point we had decided that we would list with PurpleBricks. Much lower fee's and seeing as we did all our own viewings thought its worth a go. We havent actually listed yet but funnily enough had a phonecall today from agents. I've said we aren't going back on with them. Totally polite, thanked them for the help earlier in the year but going to try something different this time.

He's emailed me that I have to pay their marketing and disbursement fee? Our term was 18 weeks so I assumed that contract was over?

Is it because they are saying I haven't given them notice? If so I can do that and list in a couple of weeks with PB.

So it's says the fee marketing fee is free? Unless there is a caveat somewhere that says it's only free for a successful transaction, I don't think you have to pay. Only an opinion though. I'd ask the agent to justify why the description "provided free" doesn't apply.

I wondered the same. He's also said in his email that it was priced incorrectly when it went on the market. They valued it at 350, it went on at 350, we had offer of 345. I'm not precious about the price, in fact we are going to go back on at 340. I'm unsure why he's even mentioned the price, annoyed I'm going elsewhere I suppose.

Is it point 5 they are referring to?? Still unsure they wre right but maybe I'm not interpreting correctly 🤔

Just spoken to the agent, we have to pay it. It's clause 3 I think he said. Anyone that withdraws their property with them has to pay it.

Yes, and from reading the bit he's said I think it actually is clear really.
