Renting - check out fee paid in advance, almost eight years ago

Hi all,

Hoping someone can advise.

in January 2017 I moved into a rented flat, I’m still in it, but hopefully should be buying my own place in the new year.

I started renting this place before the letting fees ban, and one of the many, many fees I had to pay was the check out fee, in advance.

I’m sure I read somewhere a few years ago that this is now refundable, as it relates to the end of my tenancy which will be post-fee ban. It’s only £100 so I thought I’d wait until I was actually leaving to claim it back, hence not chasing it up.

Can anyone advise if this is correct? Google has lots on the fee ban but not a lot on fees that were charged in advance but I’m sure I read it somewhere!

I just wanted to check here before I contacted Shelter etc for info. My agents are blood sucking monsters who would sell their grandmothers’ souls for tuppence so no point asking them.

Thanks!

You should have been refunded it by now. Also your agent likely took 6 weeks rent as the deposit and since the ban reduced the maximum to 5 weeks rent, that 1 week rent difference should also have been refunded to you by now.

Thanks for your response - they were required to return it, off their own backs? That’s interesting thank you, I’d not realised. They’re out and out crooks (had to return me £800 in fake rubbish collection fees after I discovered they were pure fiction) so I wouldn’t put it past them to keep it.

thank you!

Good luck dealing with them. Definitely ask Shelter for advice on how to broach the subject and request what you are due.
