Advice on bad neighbour and reporting if own

Hello

I remember reading something on here a few months ago about if you have trouble neighbours and report them then you will have to disclose that to any buyers.

We have a place that is surrounded in council , well it's a mix in the block of council and owned , it's a flat ( maisonette)

The council have moved a bit of a problem neighbour in across the door from us, until recently it was an old man , no bother, now it's a guy who smokes weed and stinks up the close and plays music loud , so far during the day. The 1st thing we said when we asked what it's like round here is that it's quiet . So....

Anyway I'm so angry , and it's because my autistic child can't stand the smell every time we open our front door.

We were desperate, so that why we bought this place off someone we know.

If it was just me I'd get on ,but kids can't cope with smells and noises and the guy is not working is from trouble he told us, what I don't know.

Any advice appreciated.

  • update the correct, when he asked what it was like just as he moved in recently , we confirmed to him it's very quiet.

Yeah you have to disclose any neighbour disputes when you sell, but if it’s an issue that is really bothering you then I wouldn’t let that stop you from reporting it. However I’d try every other way of sorting it out first, may be worth speaking to him about the smell & music volume etc, he might not realise it is bothering you or how loud it is

Yes, if you reported to the council you would need to declare this when selling. It’s not clear whether you’ve spoken to your neighbour yet? I think you’ve a somewhat equally big problem in selling if the smell and loud music is significant and constant - it’s going to put most viewers off, so if you could resolve it among yourselves first then that’s a much better option.

I think you're saying that the person you bought from didn't disclose?
Unless they made complaints to the council or directly to the neighbour then they don't have to. They might not have cared about the smell etc from neighbour

If someone else complained about it if they were up visiting and noticed it, then would that be classed as something to disclose upon attempting to sell ? My other neighbour at the other side would like to although it doesn't directly affect them.

As long as the homeowner themselves doesn't complain, there's nothing to disclose. I assume you could also complain anonymously, although perhaps the council won't be quick to take action if they haven't got a named person following things up 🤔
