I have just viewed an empty property currently going through probate.

The EA was unable to tell me much at all aside from a solicitor is dealing with it all and there are also executors.

Before I consider an offer what do I need to know and what should the EA be able to clarify?

The ea and your . Your solicitor should confirm that the seller has the authority to sell the property and may also tell you how far along the probate process is. You can make the offer but it can't be sold until probate is granted which takes months.

Ask the EA to find out when probate was applied for and whether the executors believe the estate to be a simple one, i.e. under the IHT threshold and a valid Will.

I've been involved with three probate applications in the past two years. They took six weeks, four months and, most recently, two weeks. The situation seems to be improving.

The EA doesn't have to give you details of the solicitor or Executors, but be aware of who both are. As mentioned, I'd want to know if they've already got Probate and if not is it due in the next month or so. If not, it'll be a while before completion can take place as Executors won't have any proven authority.

Having recently bought a probate bungalow, definitely ask lots of questions. We didn't realise when we put in our offer that probate hadn't been granted !...Solicitors were dealing with the sale and were the executors, and were less than helpful. We continued, as we loved the bungalow. If you go ahead, there is a site on Government website, that if you have the name of the deceased you can see if it has been granted. Good luck :)

So have just had confirmation probate has been granted and able to proceed with sale.

Interesting. We have a property to sell. It's all prepared ready to go. However because we are waiting for IHT to be approved we haven't applied yet for probate. So we haven't put it up for sale. I'm working on the premise if I can't sell it I don't want my potential buyers looking around having offered on mine and potentially changing their mind as other properties come on the market. I hope I'm doing the right thing because I read all the threads on here saying the market is slowing down
