Expedited probate

Was on the verge of exchanging when vendor died. Now have to wait for probate to proceed.
am told the son (who was selling in vendor’s behalf) is seeking to expedite probate as we were on the verge of exchange.
anyone know what that might mean in terms of timescale?
i understood probate was 12-16 weeks after application…. Does expedited mean shaving a couple of weeks off or something more speedy?

or it this a ‘how long’s a piece of string’ question?

I think it's how long is a piece of string question. All the Executor can do is phone Probate Registry and get an idea of the current timescale - which would be really useful to you so you know where it's going to be a couple of weeks or months.

It really depends how straightforward the estate is and whether it's being handled by a solicitor.

My dad's actually went through in 24 hours (during covid, massive backlog). It wasn't expedited but when I called to query, I was told that with easy estates they sometimes rush them through. I didn't use a solicitor and apparently they are supposed to have a waiting period, to allow for any further beneficiaries to make themselves known.

Each case is different, but just wanted to point out it can be done really quickly.

Two months would be an expedited timescale but it could easily be six if everything isn't in order or there are complications. It really is a piece of string question that nobody can give an answer to.

I started my Mums very uncomplicated probate in March of last year and it was granted at the end of September

We did probate ourselves, without solicitors, and it went through in 3 weeks. But ours was pretty straightforward case. I have heard if complex it can take months.

Ah I figured that it’s a case of having to wait and see. So frustrating. Am hoping that it’s all straightforward as they already did seller’s husband’s probate recently and the son had POA so I guess they had to get affairs in order for that…?

fingers crossed, then…

Just frustrated as we should have moved yesterday so I keep thinking of all the things I had planned to be doing by now!

How did it go? I’m in same position as vendor has passed away due to exchange 2 days before passing. Now gone to probate, solicitors have applied for expediting

After I made the application for probate it was less than three weeks to receive the grant in my mums case. If it is straightforward and they did it right” with all the attachments they need etc, it can go through quite fast.

I wouldn’t expect you will have it before Christmas though.

FIL's was really simple and took 2 years 😩 well it's still ongoing with one company 3 years later

Probate is very delayed at the moment. Think 6 to 9 months minimum. Long backlogs.

vendors solicitors applied for grant & to expedite because of house was sold and going to exchange. so fingers crossed. It’s a horrible process

I applied for my mum's at the end of September and we got it at the end of October. It did take about six weeks to pull together all her finances to send it off, and she was quite organised, although she did have a lot of separate accounts.

From sending in the iht forms and paying the tax, which has to be done before you can apply for probate, until receiving the probate grant took us less than six weeks this late summer.

We were very organised and my brother is an accountant. If you submit the probate form online that part is very quick—less than two weeks. The IHT forms can be time consuming and have to be submitted by post.
