Party wall agreement for a ground floor garden flat ?

Posting on behalf of a neighbour. Her neighbours in a freehold house have sent my friend a party wall agreement to sign etc, she is next door in a ground floor garden flat leasehold and is wondering why she has been sent the notice as it wont affect her, it would affect the flat upstairs. its a converted terrace house, does she ignore the notice..?? Upstairs flat has received the notice also and can see the relevance here.

Presumably she shares a wall with the house next door if the upstairs flat does?
If so, the NDN are correct to serve notice. Your friend needs to decide if she is happy to agree or whether she wants to get a PW surveyor to look at what's happening. The neighbour will have to pay.

Yes, thanks, she does,. also does not want them to do the loft as will lose a little light on her garden, neighbours not very engaging or willing to discuss much about reducing size.

The PWA covers neighbouring property up to 3m away from the property being altered. I'm assuming the loft etc has pp if needed? Is it a loft extension?

She should object to the PWA and appoint her own surveyor. This will be a cost to the neighbour, not her. Then she can be sure the surveyor is acting in her best interests. So things like access, reinstatement, working hours etc can be looked at.

The PWA won't prevent the work from being carried out.
It's unusual for a dormer on a terrace to result in a loss of light to a garden as they don't normally increase the height of the existing roof. Your friend may be surprised.
