Seller threatening to put house back on market

So we have had a nightmare of a house sale/purchase due to issues further down the chain - we are now at the last lap where every query on the earth has been answered, every person and their dog has been asked a question and a date by the solicitors has been put forward - woohoo and agreed by every person in the chain! However…… out twat of a vendor has now decided to say if we are not exchanging contracts by the 31/5 he is putting their house back on the market - this is a full week before completion! Now we and our buyers are ready as we are cash buyers but the other two in the chain are reliant on mortgages and have to deal with all of that! Spoke to him today and although I do agree with what he said as it was the lower part of the chain that’s caused the delays we have no control of them at all so the only people that would suffer is me and my husband if we don’t exchange by the 31/5! Our solicitor said it may go through but she said there is a good chance it might not as she is not privy to their circumstances and can only press the urgency of the exchange! I have made an appointment to view a back up property but I will be honest I feel like telling him to shove it as he has caused me so much stress of this and stuff I can’t control! He knows the 31/5 is my mams first anniversary of her death and I am recovering from surgery but he is still saying I’ve got decisions To make! AIBU to want to bin the house off and save my self the hassle next week incase we don’t exchange??

Where are you going to live in the meantime?

Don't you want the house he's selling? I know he's being unreasonable but if you love the house, why would you reject it now?

This all doesn't make sense. He's relisting?! Is he even serious about selling? Where is he going next?

Reallybadidea · 31/05/2024 18:35

I can get why you're annoyed but I'm not sure how he's spoilt everything, he's just made it more stressful. Seems a bit extreme to just disregard the house now and start again from scratch with your purchase. Have you got somewhere else to live once your sale has completed?

we will now be a cash buyer next Friday to buy something else - everything happens for a reason!

You might be cash buyers, but have you actually got anywhere to live for the next goodness knows how many months before you're able to buy a property? Confused

We have a lodge we can live in and our belongings can go into storage until we find something else. He was so arrogant and was not going to entertain us buying his house whilst we were in a chain and he has been threatening to put it back on the market for 2 mths now due to issues that have nothing to do with us but further down the chain. I liked the house not loved it s it needed a full renovation which was not an issue - our estate agent and solicitor were both shocked at the tone and content of his emails and how he was willing to walk away from a sale because of a couple of days waiting!! Other houses will come along I’m sure.

Good for you OP would love to hear his reaction now....what a twat!

Good luck Op - I hope this means you now find your dream house!

I’d be wondering why the 3pm exchange was a surprise to you, that should never be the case and your solicitor should not have exchanged without reverting to you, especially given the problems with this.
And I cannot see why you would be so outraged at the idea of exchanging a week before completion. It’s not unreasonable for the vendor to want a weeks notice.
Hopefully you will find somewhere else soon.

I wasn’t surprised at the 3pm exchange and they spoke to me about it before acting - as they wanted to know if we wanted to go back to our vendor which we didn’t. The reason we were surprised was that we had been told twice that day it wouldn’t be happening but one of the solicitors who was on holiday had taken a file with her and was checking her emails incase it came through which was very kind of her. I was not ‘outraged’ by the week request for exchange I was upset at the amount of threats we have had from the vendor that he was putting the house back on the market if things hadn’t been done by certain dates which were totally out of our control - I wanted the security of exchange who wouldn’t when moving???
