Gas certificate issues

I was wondering if anyone has experience with gas certificate issues. I have had for a long time significant issues with my Landlors, who insists I own too many things and that the floor is going to collapse unless I put all my belongings in storage. Just to clarify the items I own are books, clothes and a few pieces of furniture, all brand new and clean. It is a lot of books but I have seen people’s bookcases in other houses and they have walls and walls of loaded shelves. The house is most usually terribly messy due to crazy work hours, again messy, not dirty or damaged in any way. This year at the time of the annual inspection I received an email by the Landlord, supposedly sent to him by the engineer, that because I have my cooking pot on the stove, the boiler is faulty and have many things, he refuses to issue a certificate. The email was clearly written by the Landlord based on the wording. It was a shock as the items I own, the stove etc have been like this for at least 3 years and never was there ever an issue eith gas. I replied I am happy to have another check but that I do not trust the engineer who conducted the review - him and the plumbers belong to a company the Landlord pays for all his properties and I do not feel safe they are being objective. As a response I received a section 21 notice. No further gas appointments. They contacted me as the section 21 is almost at 2 months for an inspection- issue is that I am moving out to another town anyways in 4 months so I cannot reasonably move out locally for only this period of time. I asked to delay this for a week so I could be at home and received a flat no, as well as a notice that the engineer will be disconnecting the gas. Essentially that leaves me without heating or hot water- the shower has been broken for months and the Landlord has ignored it saying that my belongings are the problem. I am feeling absolutely harassed- this person by the way over the years has come into the property uninvited, has been calling/emailing at unsociable hours and has bullied me to no end. I acknowledge I owe maybe a lot of things and could use more space, but am not certain he can cut off the heating to make me throw them away..

Without a gas safety certificate he can't issue you with a section 21...
Legally he cannot..

I thought the same.. but I’m very scared he is doing this to force me out or to throw my things away. I cannot live without gas.. I am not an architect and I am well aware of what clutter etc is, but have never heard of too many books collapsing the floor of a modern building. But the engineers he employs do as he says. Early last year there was a leak that he blamed on me even though it was not due to any of my plumbing, forced me to pay almost £2,000 for damages without giving me a receipt and has been harassing me each time he visits, emails at 12 midnight and over weekends.

Block him in all ways. He can write to you if necessary.. He can't turn up to gain access without 24 hours notice. Contact your local council about not having a gas certificate.. I was advised to. My landlord is selling and we have no cert either.. Have you got the 2019 electric certificate that lasts 5 years?

RaisinGirl2024 · 28/02/2024 14:45

He’s given notice as it’s next week, but the rest.. not sure about electric certificate, I think all I was given ever was the copy of the yearly gas check. It does not make any sense. Even say that I am deluded and my house is truly dangerous then should they not have cut the gas when they came in December? Or fixed the boiler that they acknowledged in their email that was faulty.. I’m not even sure if they can cut off the gas as “fire hazard”- I know they can if an appliance needs fixing and this needs to be done in 1 working day.. but to wait to do it after almost 3 months?

Contact Shelter today op. They will be able to advise.. No gas certificate carries a fine of 6k.

For your landlord not you!!

RaisinGirl2024 · 28/02/2024 15:37

Even though he will blame me for it?

His legal responsibility to you is a safe home. And the certificates to prove it. Keep all messages.. You aren't in the wrong here.. I work for a landlord who absolutely ticks every correct box.. I wish he was my ll!! Currently awaiting my section 21 so I can argue it the same as you!

Mine has been a nightmare for 7 years. Coming in unannounced without an emergency to justify it, contacting me unsociable hours, and because he works in the building it’s like he is monitoring everything- whether the veg delivery is outside, if there is a parcel in the corridor, he’s been in the house and was opening wardrobes and cupboards and taking photos of all my belongings. As I said I might be completely in the wrong in terms of having too many things in a small space.. but still I don’t think all this is justified…

When my previous ll was a twat I reported him for making sexual advances-filled in a form at hej council who said they previously couldn't house me as I had 4 dc. And would be overcrowded ... He had suggested he call round when the dc were in bed... The council gave me a house.. 2 weeks and I was gone.
