Who is right about the shelves?

Hello!

We’re moving house soon and in the process of packing up, I was discussing with DH what was still to be done - I mentioned that shelves we have in the utility room and kitchen need to be taken down (pictures attached).

DH said we can’t take these, they are part of fixtures and fitting. I disagree and told him we’re taking them! They didn’t come with the kitchen, I purchased them from Etsy.

I’m going to double check with my solicitor, they are however closed until 8th January. In the meantime I was wondering if anyone on here can shed any light on whether we can take them or not? We live in Scotland (as I know Scots law is different).

Id definitely fake them
They so clearly aren't 'built in or been bought with the kitchen'

I'd leave them. They are part of the kitchen.

It seems a really grey area

if it helps I took mine with me. Do you know they will fit in your new house, no point taking them if they’re no good when you get there.

you could just pop out and buy some cheap ones to stick up.

Did you complete a fixtures checklist to state what was included in the sale? We’d had some beautiful oak shelves made and wanted to remove them so made sure that it was highlighted on the checklist that they wouldn’t be staying.
To be honest we took everything with us, curtain rails, light fittings (we replaced with the basic pendant type before completion) fitted blinds etc.
We did get a shitty message from our buyer saying that we shouldn’t have removed our washing line 😂
