We are buying a house which has an Annex. Separate door and it's effectively a one bedroom flat. Living room, kitchen, bathroom and bedroom.

In the convenient d and deeds It states that we cannot rent it out - it has to be ancillary to the house. So for example for elderly parents or a nanny.

However surely I'm allowed to have a lodger who lives in it?!

Surely a lodger has a rental agreement so unless a relative directly connected to you you cannot rent it out to a lodger, you'll be in breach of the planning permission and likely to face enforcement action by the council. They may not find out for a month or two but they will and they will definitely prosecute as the condition on occupancy by a relative is placed for a reason to stop it being rented out.

Don't forget the annexe will also come with it's own council tax bill, even a band A with add £'s to your outgoings.

If you're getting a mortgage check that they will proceed. Some won't if it's got a separate front door with no through door,

Don't think they would be a lodger as it has separate door and facilities. It would be a tenant with a tenancy agreement and that would no longer be an ancillary use.
