Neighbours and allocated parking space

Our neighbours are very unpleasant to us. We share a large drive, which they own. However in the needs it says that we have an allocated parking space on part of their land. They also have their own adjacent allocated space, and our other neighbours have one next to that. They don't park in the other neighbours's space but have recently started allowing their guests to use ours. This isn't a massive problem for us as we have another potential space nearby. However we've politely asked them to seek permission from us first in case we need to use the space on that occasion for our own visitors. They've spat the dummy out, sent a very combative message in reply, describing it as a 'grey area'. They seem to think because it's their land that they can do pretty much what they like. It's not a grey area, is it?!

I don't see how it can be their land if its your parking space

TheSpottedZebra · 13/11/2023 20:21

Do you know the exact wording on the deeds?

DogLegMotor · 13/11/2023 20:28

Having no control over an allocated parking space and just like yours where the neighbour actively encouraged other people to park in it to make our lives harder made us move house. We didn't fuss, just let it lie and quietly put our house up for sale, no for sale board.

@Tryingtryingandtrying happens lots with shared drives. One person owns it but the other houses have either access over it or parking rights, it is in the deeds of both properties.

@LeglessinRotherham I would pay the £3 or whatever it is and download their deeds from land registry. This is perfectly legal, you can access anyone's deeds this way. Make sure theirs match yours in terms of parking etc before you proceed. And don't go down the legal route, just keep it all friendly because you have to live next to these people for a while.

What does it actually say on the deeds?

HiyaWatha · 13/11/2023 20:50

Do check the deeds. We have a similar set up (I own the drive), and the deeds state that other houses have access across it. I do allow them to park, but it’s not a right.

LeglessinRotherham · 13/11/2023 20:58

So the deeds visually mark out the three parking spots I've mentioned, and over each one is written the number of the house the space is allocated to. There are also areas marked out on the drive that neither house is meant to park on to avoid blocking access to the other ones garage. So technically we think both houses are only meant to park in our allocated spaces- the deeds are from the 70s when presumably most people had only one car. As neither of us use our garages for parking, we both park directly in front of our respective houses, which we think technically we shouldn't but it's done through unspoken mutual agreement. The difference is that they have two cars and we only have one. So our allocated space is often left empty. But we do need it at times.

Sorry to hear that ,@DogLegMotor and thanks for the advice, that's a good idea

What does the written part of the deeds say? That will explain the use of the land.
