Insurance after next door had a skip that blew a door onto my car in bad weather

Help next door had a skip and unfortunately the door placed on the skip blew on my car causing damage . Are they at fault

Of course they are at fault though I have no idea how you go about claiming from them. They should pay for the car repairs.

I think your car insurance should claim off their home insurance.
A few years ago my car was driven into (while on my drive), my car then damaged next door neighbours fence. Neighbour used house insurance to claim against my car insurance, then my car insurance claimed against car that went into mine.

you can only claim against them if they can be shown to have been neglectful - i.e. if they propped the door up badly right next to your car and it falls on your car. You can't claim if it is not their fault (wind). That is what your car insurance is for.

You might have a claim if they set fire to their shed and it sets fire to yours - but not if lightning sets fire to their shed which sets fire to yours etc.

It is always a difficult one to explain, as most people feel that it is unfair, but it is how insurance is set up...

of course you can always attempt to claim against their household insurance - nothing to stop you trying, but there is a very strong chance that they will either ask you to provide evidence of your neighbour's neglect or tell you no thank you...

so to answer your direct question - no they are not at fault - and that is why your car will be insured...

They're only at fault if they have been negligent. Wind blowing things out the skip isn't negligent unless the skip was piled too high or in another unusual way.

However if the door was properly in the skip and caught in a strange eddy of wind which lifted it out that is unlikely to be negligent. Of course it is no good just saying they overfilled their skip - you would need evidence ideally in the form of photos.

fair point - though such overfilling is likely to only lead to a door slipping onto the ground - the fact that a door can lifted by wind onto a car is unlikely to be related to how the skip is filled - or certainly very difficult to prove...

Very fact dependent. Photos will show how close the skip is to the neighbours car and whether the damage was foreseeable
