Private rental question

My friend, her DH and 3 dcs want to rent a 3 bedroom property and have found one that ticks the boxes but in the particulars it states a maximum of 4 people. Is this a legal requirement or for insurance purposes? Have googled it but can't find any clear answers. My friend doesn't want to get her hopes up if it's not possible with 5 tenants. Any ideas?

It will be due to statutory overcrowding so they advertise how many people rather than bedrooms

It states it's a three bedroom so would she be able to rent it?

My guess would be that 1 of the bedrooms is tiny and more that likely would accommodate a toddler bed only.

In Wales if the home is not meeting statutory requirements then the tenant can withhold rent until resolved. Hence why it's number of people being advertises and not bedrooms to try to prevent this.

There is no harm in your friend asking, and see what they say

If it’s in some London borough’s it’ll be about HMO licence. So a max of non family sharers but as a family unit it wouldn’t apply. As long as the children aren’t over 18 they aren’t included in the contract.
