House sale, list every plant in garden?

Shallysally · 01/10/2023 20:12

Just that really. I’ve been told that I can’t dig a plant up when I move as everything in the garden is included in sale of the house.

It’s a memorial plant and I would replace with same. Just wondered if anyone has experienced this please?

As exchange and completion take time, any plant may "die" for whatever reason during this time, you can't control mother nature, right?😊

PTSDBarbiegirl · 01/10/2023 20:17

Oops the frost was unkind this year. It's gone.

sjj28358 · 01/10/2023 20:19

How would one "rose bush" look any different from another "rose bush"?
if you replace like for like, then who will know?

Or just don't put the ones you want to take on the form.

975zyx · 01/10/2023 20:22

Move it to a pot now, you can take those with you. Also, who would know anyway, and is anyone going to back out of a house sale for one plant?

parietal · 01/10/2023 20:25

My mum has taken multiple plants every time she moved house.

Agree you should definitely put it in a pot now and then there is no argument.

dogpig · 01/10/2023 20:25

My ILs take all their plants with them when the move. They are keen gardeners and some of their plants, grown from seed, would cost a fortune. I assume they let the buyers know though, rather than leaving a barren wasteland behind...

Gettingbysomehow · 01/10/2023 20:27

I've moved house numerous times and have never been asked to list plants.

Shallysally · 01/10/2023 20:36

Thanks all.

@PTSDBarbiegirl unfortunately I’ll have moved by the time any frost arrives, well hopefully I will have anyway!
But good call, thanks!

I think I’ll pot it and replace with similar.

Have you already sold or just planning ahead? Before I put my last house up for sale I transferred the sentimental plants into pots and then stated on the form that they weren't included.

If you've already advertised and sold I'd take them and say that they'd died if anyone asked 😬

Shallysally · 01/10/2023 20:44

@sparkypupp already sold. I should have thought about it before now.
I’m sure they aren’t going to quibble over one plant but you never know I guess!

It’s hardly they’ll notice over one plant and for what the legal costs would be - it really ain’t worth it - just take the plant - and don’t worry about it. If your buyers try to take you to court then they need to give themselves a shake….

Shallysally · 01/10/2023 20:45

I agree @good96.

carly2803 · 01/10/2023 21:20

just replace it with anything
doubt they took pictures?

and you can say it died anyhow!

CCTVcity · 01/10/2023 21:25

We filled in the forms with plants we were taking. We have a number of rare plants. It was non negotiable. No fucking way they were having my prize specimens.

FrodoBagginsToeHair · 01/10/2023 21:30

i removed all the plants I wanted to take before viewings happened and put them in a friends garden in pots

DisforDarkChocolate · 01/10/2023 21:31

Anything you want to take put in a pot now, let buyers know all pots are moving with you

HeddaGarbled · 01/10/2023 21:36

We took a few special ones but I did let the buyers know and they were fine about it and didn’t ask us to replace them with anything.

onebornsecibd · 01/10/2023 21:42

Been told by whom?

Surely nothing is really decided until changing of contracts?

sparkypupp · 01/10/2023 22:12

I would just take it and if asked say it died / got diseased.

If you haven't filled in the TA10 yet and really want to be honest, record on there that it's not included. I wouldn't bother replacing it though, if it leaves a huge gap I'd just move some plants around.

PinkRoses1245 · 01/10/2023 22:23

Of course take it!! How would buyers even know. Fixtures and fittings are stuff like kitchen appliances and blinds, not plants. Most sellers leave stuff they haven’t mentioned on the form.

Bluevelvetsofa · 01/10/2023 22:59

I have a couple of roses that I bought in memory of a friend. I wouldn’t be leaving them if we move.

Cyantist · 01/10/2023 23:13

On the TA10 there's a specific part that asks about trees/plants shrubs. Did you say on there they were included? If so I'd take them and replace with something similar. If you haven't filled it in yet just list the ones that are not included.

SuddenlyOld · 02/10/2023 07:20

All my memorial roses are in pots. On the inventory form I said I was taking all pots.

Having said that I have lost one memorial rose so taking them with you is no guarantee

I will replace it with a new rose.

In your case I don't think I would be bothered about digging it up, I'd just get a replacement for the new house.

I have several hard-to-find plants and for those I've gathered seeds or taken cuttings. I've always done this so have had some plants move with me to 4 different homes

Twiglets1 · 02/10/2023 07:56

How ridiculous. Just put it in a pot and replace it with something else in your garden and I doubt they would notice or care.

PinkSparklyPussyCat · 02/10/2023 14:49

I don't remember listing plants when DM's house was sold. I hate gardening and wouldn't know what anything was anyway! DH dug up a plant I wanted from the front garden and it wouldn't have occurred to me to tell anyone.
