So we’ve recently moved in to a house (5 weeks ago) I’m a FTB and my partner isn’t, he doesn’t have a 2nd property but had a house with his ex wife before divorcing and selling. On our final settlement from the solicitor the stamp duty hasn’t been put on but was on the quote given to us before we started the property purchase.

I’m just wondering is this an error or will we get the stamp duty cost a bit further down the line? Seems odd as we’ve had the final settlement through the post and we are paid up on everything else. If we leave it would we get charged or isn’t it our fault as wasn’t on the final post from them?

I would query it.

You have to pay what you owe, tax fraud is obviously not a viable option, so just ask about it.

You won't get into any trouble if you flag it. The solicitor should have already deducted it IIRC.

If the price was over 250k, I'd contact the solicitor.
If they have assumed first time buyers, and you are not, it could get messy in the future.

Yes we paid £325,000 for the house. So I’m best off calling the solicitors tomorrow?

You are liable for the stamp duty so it is needs to be paid asap before any penalties are incurred

Was the stamp duty amount stated on your completion statement?

As PP said, completion statement details everything that needs to be paid, that is the time to query. I am really sorry OP, but it looks like the stamp duty is due, unfortunately if you buy a property together when one is ftb and other has owned property before, if the property is over a certain figure (of which yours falls into) But your solicitor is the best person to answer the query.

That's very strange if there was no entry at all for stamp duty on the completion statement (even if none is due, it should show this) - contact them today and query it.

Usually the Solicitor will pay the stamp duty on your behalf on the day of completion, as well as registering the sale with the Land Registry etc.

I wonder if a mistake has been made because the solicitor knew you were a FTB @LWestYorks and forgot your partner was not.
