Estate agent acting weird?

Hi all,

We have been in the process of selling our flat since April. Our management company is not responding to our solicitors questions. Our estate agents phoned me late yesterday and said that our buyer will walk away if they don't get any information by tomorrow (which is today). I said to them that I will phone the management company today to see what is going on but I don't think we will be able to get any info in 24 hours but we will try but could you put the property back on the market. The estate agent said that they don't think that its a good idea at this point, saying it like we are the ones to walk away, the buyers said that. As our estate agent I think they should want to act quickly in this situation to get it back on in case the worst happens, its just very confusing. Could they be lying, if so, for what reasons?

Eh? The agent is trying to get this sale through. If I were you I’d be on the doorstep of the management company at 9am this morning, unless you are in a different country. If you are, then be on the phone at 9am and making sure the person in charge knows they are holding up your sale and they must pull their finger out this morning and get all info over to your solicitor.

I think the EA is trying to push you into getting it sorted, the buyer is perhaps nor being serious but also pushing. Wait and see before you go back on the market. Push the management company. How long have you been waiting for the pack? Should take 3 weeks at normal speed maybe

You need to show the EA and Buyer that you are serious. You need to be proactive now and get the answers needed. The answer isn't to find a new Buyer, they and their conveyancing Solicitor will raise the same queries! Get on the phone ASAP.

The agent can smell disaster if this falls through, he knows they won't be able get the same price for it if you go back to market. I would spend the day playing merry hell with your management company and also make sure your agent knows you are doing your best to get it sorted out.

The issue isn’t that you need a new buyer, it is with you / your mgt company as seller. Relisting and finding a new buyer will not resolve the problem, putting pressure on the mgt company is what is needed.

If it's a leasehold property there should be a management pack which you as the seller pay for and gets send to the buyers solicitor. Have you organised that? If there are further questions beyond that the management company should answer in a timely manner but unfortunately it's not always a quick process.

The solution if for you to phone your management company and get a proper response from them, not to put your property back on the market. The same issue would crop up again with a new Buyer, anyway.

just phone the solicitors and management company and explain that the buyer will pull out today if details are not provided. you need them to act fast.

if you can visit the management company in person to get the details in person

The estate agent is trying to move along a process which has been going nearly 6 months, before the buyer throws in the towel.

If you were to put the property back on the market you almost certainly haven't got a buyer any more.

Have you received the 'sale pack' from the Management company? I sold an apartment 18 months and once I had paid for this the sale went through very quickly.

The EA can see that the flat is unsellable without the info from the Mgt Co / Leaseholders

Hang on, do you mean you want them to put it back on the market even before your buyers have officially said they will pull out?

When it is your side that is causing the issue? The EA is right. Get the pack, make progress!

As everyone has said it's not the EA that is wrong here. You need to get onto this sharpish if you want to sell your property.

There is every possibility your buyer will pull out with these unacceptable delays, but so will your next buyer as everyone will need the information that is not being chased to proceed.

In buying and selling property you do need to take an active role yourself chasing up the various elements to ensure that the transaction takes place.

Your estate agent cant sell the property if you dont make sure that is in a saleable condition.

Why have you let your management company away with not communication with your solicitor?

Your solicitor is going to charge you for the time they spend chasing your management company.

You need to get on the phone and find out what is creating the delay, what is being done to solve it and get a firm time line from the management company on when they will deliver the information.
