Water coming through from upstairs

I own my ground floor flat and the flat upstairs is owned by a housing association. If there is a leak from the upstairs bathroom into mine who is responsible for fixing the damage to my bathroom?

should I be claiming on my contents insurance to fix my bathroom ceiling? Or should the housing association be fixing it since they are the owner of the upstairs flat and the source of the leak?

Hi,

Sorry to jump on but I am going through this right now.

A neighbour has learning difficulties so I am communicating to through their parents and the HA.

I have called the HA and they came last night but the neighbour above did not answer the door. I feel so lost as I am trying to communicate with both and it feels like neither of them want to help.

I feel like I am going to burst into tears at any moment.

The water came through the light fitting and blew my light and the extractor fan. When I knocked on the neighbour, he opened the door in a towel, so I am assuming he over ran the bath.

I now have marks all over the walls in the bathroom and paint has come away from the walls.

I have noticed small drops coming through my front room ceiling.

What do I do next? The building insurance is a £1000 excess and I really don't want to pay it when it is not me at fault. The insurance mentioned holding the neighbour accountable but I have no idea how that works.

I am hoping your experience might help me.
