Probate

Hi We’re waiting to exchange contacts on a property. The sellers are moving into a probate property. Apparently probate was granted 3 weeks ago but the solicitor is awaiting the probate certificate. Does anyone have any idea how long this usually takes as our buyer is not happy.
Thank you

Once probate is granted it should be possible to get the certificate very quickly. It's the lead up to probate that can take a long time.
The vendor could probably speed it up. Solicitors tend to just wait.

I thought the certificate was issued at the same time you "get" probate.

You should be able to download a copy on line at the link the pp came up with.

Thank you it seems on further questioning probate may not yet have been granted even though we’d been told it had.

The probate registry are taking around 10 working days to post out the Grant once issued.

Do you know the name of the deceased? You can check if it has been issued if you type in "find a probate" on Google and go to the gov website.

I'm a probate solicitor.

I have recently done probate myself. It took over five months from online submission to getting approval, which is not unusual at the moment I'm afraid.

The grant arrived the day after I received the email to confirm everything was approved.

Our sellers have just got the grant and it took 3 months from time of submission, and they've been told it will take 10 days to get the document in the post.

Thank you, have heard back that probate has definitely not been granted yet.

Sorry to hear that. It may be a while. They won't even begin to escalate until after 16 weeks from submission. Do you know when that was?

Piglet6776 · 16/08/2023 18:59

Was submitted in March!!! I think the family hadn’t chased up at all and when they did more paperwork was needed. Seen an email from last week saying they had all the paperwork needed had escalated it and were working on it. Problem is we have no idea how long will take.

Ok. So when I escalated mine it was approved just over three weeks from my first call, and as I said previously, the grant arrived in the post the very next day ( they said allow ten days.)

I called every week. Things might be slower now because of short staffing over the summer.

I do hope it resolves for you very soon.

I think it’s a bit hit and miss with the probate registry and also depends if all the correct paperwork submitted in the first place. I didn’t think you could chase them up but I may be wrong. But a simple application is about 3/4 months I believe.

FiveShelties · 17/08/2023 09:41

I applied in early June and got the email to say it had been granted yesterday. When I applied the Probate Office confirmed receipt of the documentation and said it could take 16 weeks and that you could not chase until the 16 weeks were up.

The email states it takes 10 working days to receive the actual document - I live in NZ so no idea how long it will take to arrive here.

The time to get Probate seems completely random - some seem to take 6 months and others 6 weeks - have no idea what makes the difference.

I have just done probate recently - application went in
Aug22 and was granted early December 2022 - our estate was small with one property below inheritance tax value - length of time it takes depends on process of probate registry. Also depends on how complicated the estate is - number of executors needing to sign documents. We listed the property before probate was granted but had we have got a buyer before probate was granted then we were told they would have to be informed that there would be a delay in completion. As it turned out we didn't get a buyer until after the probate was granted. Sale is progressing now.
