Looks like I’m going to end up evicting my tenant (it will be section 21 but I know she won’t leave so possession order/bailiffs)…just wondering how the bailiffs actually remove someone from the property? Can they physically move someone? Or do they just wait until they are out and change the locks?

what happens if there are pets in the house?

what happens to the tenants belongings after that?

(no discussion about rights/wrongs of section 21 please - we need to sell for financial reasons)

@C4tastrophe Unfortunately professional landlords aren’t really any better. They have no qualms about liquidating some of their portfolio when there is a significant gain to be made and don’t always reinvest at the same time, waiting for prices to drop.

I just had to agree to a 30% increase in rent because the open market would have been a lot more expensive (fairly central London). I’m lucky that I can afford that. A lot of people in my building can’t and are moving out.

@Parsley1234 - I think some posters don’t really understand what it’s like to be 25 years old and living in London because your job doesn’t exist anywhere else and having to live in a shared house. Eventually those jobs will earn them money, but in the meantime they need housing at relatively low cost. Double whammy of stagnant wages in some industries and rapidly rising costs. I feel incredibly sorry for some of them.

Vilifying landlords is not the answer start with your politicians build more homes at reasonable rent can’t you see the BTL market picked up where the government should of invested now they’ve created a perfect storm landlords leaving rents rising just a bloody mess

@Parsley1234 the old terraces will be sold at a price where updating them is viable, either to owner occupiers, or other landlords that have the means to renovate them.
In the meantime there is a ‘correction’ that will have to happen due to the mess created up to now by lax policy.
More housing needs to be built. Not necessarily houses, but housing. I don’t have an answer to that, though you see pension companies positioning to move into housing for stable returns.
I don’t have a gripe with professional landlords. I do with arsehole one or two BTL landlords that can’t afford to maintain their properties and sell them when cash is short.

@C4tastrophe I have been a landlord for 25 years I’ve been fair reasonable helped a lot of people through a DV property etc the vilification of landlords and the attitude of this government is awful we filled a gap that no one else did and now we’re being forced out which is fine by me but where will my tenants live after I throw in the towel. Rents I’ve kept stable through the years now are leaping up to cover increased mortgages and tax obligations

@C4tastrophe yrs I can see the way the wind is blowing but with no alternative where are these people going to live ? A massive homelessness problem we have and it’s getting worse please don’t get me started on the government cap on rents for UC peopke think landlords won’t rent because they’re on benefits nope it’s actually your rent won’t be covered atall

It will be a long process. One of the hardest parts will be issuing a valid S21 notice. You need to check what needs to be in place in terms of certificates etc or you'll get all the way through and then find the initial notice wasn't valid and have to start all over again.

It's shit but country is in shit housing state atm.

My tenant I offered money to go as it takes so long to get a possession order 2 months notice 2/3 months court date then balliffs 1/2 months depending on where you are in the country L. All the while they stop paying rent and trash the place - I hired an eviction specialist who got him to sit up and take note of what I was saying

Tenant will not be able to get private rental (no job) so will need council help which she will only get if I do full eviction….

£2k to get paperwork to get to court plus balliffs
I offered him £2.5 to fuck off he owes £900
if I waited for court he would owe another £3.8 minimum with no guarantee of a possession

@DorotheaDiamond its such bullshit is she paying rent still ? Just cut your losses start the proceedings she will be able to present herself as homeless day before balliffs come re the animals you could pay their boarding fees or find a fosterer for them.

@C4tastrophe they were living in a house that they decided rent was an optional bill they have a large GS in a 2 bed terrace leaving 50 piles of dog shit outside why shd I subsidise these people no thanks I would rather get a proper tenant who pays rent and doesn’t leave it in a state. Actually I was talking in a bigger term than my situation the fact that 28000 landlords are leaving every month where are those people going to live rents are spiralling due to lack of houses as landlords are leaving and as usual government has no plans to house them

Hello.

I am purchasing a property with tenants refusing to leave. Seller has got a solicitor involved to help. Time line as follows:

s. 21 notice issued May 2023, landlord was kind enough to give tenant 3 months instead of 2. Tenant refused to move, initial application for possession order 10/08/2023. Gave the tenant 2 weeks to file for a defence (she didn’t). Full application for possession order 24/08/23, came through on 18/09/23 giving the tenant 14 days to vacate- by 02/10/23.

If tenant refuses to move, have to go back to court for writ of possession and bailiffs. Unsure how long this will take but I’ve heard 2-5 weeks, but depends how busy the court bailiffs are. The tenant will be provided with a further 2 weeks notice of the date bailiffs will come.

if tenant is requesting support from council as being made homeless, they need to take/email a copy of the possession order to their local authority homeless team to request support. Most local authorities accept this as evidence you are being made unintentionally homeless and you shouldn’t have to wait for a bailiff date and bailiff’s to come (v. Stressful for everyone esp if kids/pets involved).

FYI- this is the process for no rent arrears/monies owed. I believe it’s a different process if you need to recoup money.

Hi
i have tenant and their agreement will be expired soon. I need to let them leave as they are damaging the property by condensing, making moulds on the property etc. I am looking for eviction lawyer who will provide Section 21 notice and give them 2 months to move. Any advise or recommendation for eviction lawyer who can evict the tenants once the tenancy agreement expires.

You do not need a lawyer to serve s21
it's a one pager that needs to be delivered physically to the address/receipt confirmed

@MeAmy the only one I know is Paul shamplina at landlord action. You can find them online.
