Rear fence - who responsible for

There’s a fence between our garden and that of rear neighbour which is not mentioned in our title deeds.

(deeds require us to maintain the side fence to our right, facing toward garden)

the fence posts are on the rear neighbour’s side and we wonder if that means it’s wholly their responsibility or is it shared?

It's usually whoever has the good side favpcing them that owns the fence, you wouldn't put the ugly side your way if you erected it.

Generally @Doggymummar, you put the ugly side facing you if you own the fence! I'd ask neighbours what they do. If not mentioned then it's fair to share the cost.

Did there used to be an alley between the gardens? Sometimes people enclose part of an alley into their garden by erecting a fence outside their official boundary and then it becomes unclear whether it's a shared fence or whether both properties should put a fence up. Does the fence match or is integrated with either your or the neighbour's side fence?

Not quite sure which is the ugly side! But they do have the fence posts on their side.

both deeds are silent on who erects/maintains rear fence.

he is a difficult man to deal with and if it was clearly his responsibility I would not have to deal with him.

am thinking that I might erect my own fence so that I can avoid him.

Usually you put the fence posts on your land and the fence line along the boundary.

People have started to put the fences the other way round recently, to have the 'nice' side. The posts should still be on your land though.

You can erect a fence on your own land. I am never sure what happens if the original fence is taken down though. 🤔

I am sorry he is unreasonable. Usually the best way is to agree on the fence and position and go halves.
