Need some advice on how to go about with this

Dear All
I am at my the end of my patience and became very emotional( yes I know that I need to learn the art of detachment).

I do not want to bore you with the long story ( can personally message if you like to) or put it in short threads to ask for some advice on several points of this application( demolish and build).

We handed in the planning application in Dec and validated and the consultation period was prolonged due to no signpost put on).

We have a big objector (29x) who does not want us to have a bigger house (a derelict house that needs to be redeveloped). She has the biggest house on the road. Wrote a 5-page objection.

The neighbour on the other side(28x) supported us on day 1.

At the end of the consultation period, 29x went to 28x and used her version of the plan to tell 28x that our house will be right up to the fence and will block their morning light in the kitchen window( on the side of the house) and the back. Nice of 28x to let me know about this.

The consultation period has passed and the planning officer ( PO) received an email from 28x to object to our plan citing it will block the light to the kitchen ( that window has been in the shade due to a tree for over 20 yrs) and they asked us to chop the tree down which we did and same for the back

However, 28x would like to object now.

I mentioned to 28x to look up the council site and there are different color lines of the old house and new house. The other points are:

  1. There is a 1.6m between our house and the fence.
  2. the fence is 1m high ( we are tempted to erect a 6ft fence on this)
  3. We won't have a loft and our roof is lower than theirs
  4. we are building smaller than the permitted development.
  5. 29x has never spoke to 28x over the couse of 2x years but once only ( this is from 28x)
Still, 28x will not listen. They want to use the same excuse as 29x that the kitchen on the side of the house is their main room. (The Kitchen is connected to a very bright room at the back which is south facing)

Now my question is---How does the council take this? Is the objection still valid? The PO is planning to visit 28x on this.

  1. We have been very transparent on day 1 -showed the plans to 28x, personally, in their house,
  2. we have tried with 29x but she refused and wrote a 5-page objection. ( another story)

The planning process is the planning process. They can submit an objection now and planning may or may not take it into account (my local does take things into account beyond the deadline). Planners will decide outcome and on you go with your lives. However if your development is making next doors house 'worse', don't expect them to be friendly with you.

They may have to get a ‘right to light’ survey done if they haven’t already done this. Ultimately that will decide if you get to go ahead or have to adjust your plans. I’m not sure I’d be happy with a significant light reduction in my main room whether or not I had another south facing room!

Pls, enquire before making a judgment. Assuming development is bad for neighbours. The light report was already done before the consultation period( with neighbours not cooperating with the layout and dimensions of the affected area for the light consultant).

Also just mentioned previously- Light report -if there are connecting rooms or adjacent windows which are bright then the concerned window is not much affected.

Research it before commenting pls. They are overshadowing the current derelict house.

You don't have an automatic right to develop, the process will just have to run its course.

I don't know why you are getting frosty with the replies. They are factual. If the neighbours are objecting then there is something they don't like!

Planning had got more and more permissive, my council pass some horrible things. Their policy is to err in favour of development.

If you get refused planning you can appeal to the planning inspectorate.

Just a warning though, pissed off neighbours can make life quite unpleasant.
