Hi all

Thank you in advance for any advice

We put our house up for sale in January. Sold in twice and both sales have fallen through.

My mum was telling someone about this rj a friend at a local club and they said they wanted to move, we arranged a viewing privately and she's made an offer which we have accepted. Now this women never new the house was for sale as she wasn't looking but now am I liable for EA fees even though they didn't help this sale at all?

Depends on your contract with the EA. Have you given them sole selling rights? If so they're due a fee because the house has been sold while you're in contract. If not, and they didn't introduce the buyer, then they're not due a fee.

What did you contract say?

If you're not in a time limited contract I'd remove the house for sale with them and then continue with the sale privately

as others have said you need to look at your contract. think ours said 12 weeks exclusive selling rights even if buyer didn't come via them.

Ours says 16 weeks exclusivity which is about to end but then a 30 day notice must be given so I assume I'll have to pay them as no parties involved want to want anther 30 days to progress?

Going to get some legal advice on Tuesday
