Never ending house sale woes

Ladies - this is probably more of a vent than asking a question. But if anyone has any experience or advice I’d really appreciate the words of support!

DH and I have had endless issues with selling our house (noted in my previous threads). Our first buyer pulled ghosted us for a month. Then pulled out after a second viewing without a reason. Luckily we found a new buyer who has been very responsive throughout but there was mortgage worries because he was self employed.

Today we finally heard that they’d got their mortgage offer which was a huge relief, but now the solicitor has informed us we still aren’t registered as the owners of our property with the land registry (we bought the house in 2019 when it was built).

To make matters worse, our solicitor applied to expedite registering it into our name and the land registry said there was a previous application to the title that could cause delays. Now not only do we have no idea how long it’ll take to get it sorted but our buyers AND the developer of the new build we’re buying are getting worried and impatient as we’re due to exchange in a few weeks.

Please someone tell me it’s going to be okay! I never want to move house again!

All I can say is that a good solicitor is worth their weight. We sold/bought in lockdown and had a few issues with boundaries and I think the registry and some of it was dealt with after completion.

I wish you all the best and remember if your buyer has got this far, they will probably want to continue as well.

Honestly I ask myself the same question. We’ve also remortgaged on this property once already so you’d think any issues with the land registry would’ve come up then!

Our solicitor has been pretty good but these land registry issues will have to involve the previous solicitor and they aren’t going to be efficient when they’re making absolutely no money by helping us haha!

I am sorry I can't be more helpful but I had recently read stories of land registry not registering current owners for well over 1.5 years and it regularly causing problems, I think it might have been an estate agent blog or similar.

So, I don't think this is unique to your property. Definitely look into their backlog and what on earth is going on.

Oh this happened to my parents , solicitor they bought from didn’t register . When they were selling solicitor was on his death bed. They had to go through his insurance it was very time consuming … took over a year !

@llihl13 shows how slap dash they can be!! I hope it doesn't take too long to sort out & that your buyer sticks with you! If not it must be a nice house as you've had plenty of interest! & at least this would be sorted before the next one!

Your previous solicitor neglected to ensure your house ownership was registered? I'd be threatening law society action and claiming on their professional indemnity insurance unless sorted within 7 days. Then see how efficient they become! I'd be fuming!

Yeah, something has obviously gone wrong somewhere seeing as every other house on the estate is registered. I will absolutely be threatening to sue if it doesn’t get sorted!

We had an issue with the title of the land in the house we were buying. A mistake had been made when the previous owners bought it meaning the land hadn't been transferred correctly. We had major delays waiting for the solicitors to sort it out. The solicitor suggested looking for somewhere else as she thought it was such a challenge to sort out. It wasn't that bad in the end, but took a while to sort. We had to ring them often to check they were dealing with it as it seemed like they put it on a back burner. Keep checking in with them to check progress and good luck!

We sold an aunt's house via probate. The house was built in 1925ish and was owned from new by the aunt's parents. When we came to sell it we had the deeds but it had never been registered at the Land Registry. Can't remember exactly what our solicitor did but basically the solicitor arranged for it to be registered straight into the new owner's name bypassing the aunt and us via inheritance as owners. No delay at all. Maybe ask your solicitor if this is a solution? We had to show birth and death certificates for aunt and her father.

Thanks, will definitely keep chasing. How long did it take do you remember? Our solicitor has expedited our case but still not sure how much faster that’ll make it

We let our house sale go through, moved out and rented for about 6 months I think.

bought this house Dec 21 now part ex (back to barratt/DWH) and moving to a DWH….come to light today we aren’t on the land registry and it was expedited last week but we are due to complete 28th!!

If you haven’t already, go on the land registry forum and start a thread explaining your situation. Our application has been looked at within 3 or 4 days because the guy on there chases it with the casework team. You should be fine for 28th if you do that! Good luck!

Sorry to hear about your selling woes. It really is stressful. We had a similar ish situation when we bought our house. Quite a way down the line the solicitor discovered that our garage wasn’t registered in the vendors name. The house is freehold but has a separate leasehold garage as it’s in a block of garages underneath a coach house. When the vendors bought the house their solicitor failed to transfer the deed on the garage meaning that it was still registered in the name of the previous owners.

it all got very complex as the previous owners had split up and had to sign the paperwork for transfer separately, it got posted and lost during the postal strike. I eventually threatened to pull out and the estate agent handling the sale and solicitor pulled out all the stops to get it sorted.

it added about an extra month onto the purchase which was frustrating as there was only 3 in the chain and should have been a fairly straightforward process.
my advice would be to keep chasing the solicitor and get them to expediate the transfer via land registry
