Can anyone explain these restrictive covenants (photo)

I fell down a bit of a rabbit hole looking at the history of our house and came across these covenants amongst our paperwork. Most are self-explanatory, but I'm a little baffled by numbers 4 and 5 and want to check that I'm reading them correctly. Are we not allowed to have a shed? I assume we can dig the 'sand and gravel' for a house extension? The wording is throwing me a bit.

I think No4 about keeping chickens. I have a similar one and it dates back to a working farm next door. A poultry caravan is a chicken shed on wheels.

No5 is about you making profit from quarrying I reckon.

That makes sense, I read it as if there was a comma after caravan, which there clearly isn't.

Definitely have no quarrying plans either so that's a relief!

We have similar. No chickens (or pigs), no quarrying and no running a brewery apparently.

We had no brewery in our previous property, as well as no garage/petrol station. Bizarre, but clearly important to someone at the time!

I cannot store fairground rides or sideshows in my garden. It's all very archaic. Shows what would have been considered non-u when the house was built.

I doubt they would be enforceable these days, unless you had a neighbour with a pathological hatred of chickens and a lot of money to burn on legal fees.

They are still very much enforceable just most people don't know they have the benefit of covenants that they can enforce.

The single dwelling covenant would for example be a major issue for a redevelopment of your property.

May or may not be insurable and may need a deed of release from the person who has the benefit

My house was built around 1990 and the covenant states no chickens, cows, pigs and I think goats! I'm also not allowed to store a caravan on the front of the property.

They may no longer be enforcable. Looks like the covenants are in favour of a company (which may no longer exist, or which may have no connection with your property any more) - and I suepect most of your neighbours have sheds, so when that happens all the covenants not to have sheds become unenforcable.

Covenants, even recent ones, are barely enforceable so no worries on that front - I had some crazy ones on my last house including not being allowed to have patients stay overnight? And no staff to be allowed to sleep in the attic (which was 4 ft high) plus no farm animals and max length of grass.

New house has no caravans, no work/trade vehicles, no farm animals including chickens, max 2 dogs and/or cats

The covenants look like they come from an abstract which is a short form copy of the deeds which created the title over the years. Covenants bind the land, not the people - so they are enforceable, potentially by your neighbours even if the company does not exist any more. But what're the chances of anyone enforcing them? Slim.

When you bought the house, your solicitor will have prepared a report on title for you to read before you signed the contract. Any subsisting covenants will be referred to in there, if they are doing their job correctly.

Here, it looks like these might be very old - as I said, there's nothing here that tells me they affect your title. Look on your register for that.
