Landlord doesn't want to do GSC

Contacted landlord to remind them about annual gas safety check. LL has read my messages but no reply. She is generally not enthusiastic about the place (ceiling water leaks that she ignores, mould and damp on walls, things falling apart easily, has not bothered to inspect the property since we moved in 16 months ago). It is a council owned building so likely ex-right to buy that LL is now profiting from.

Do I have any recourse here i.e. can I report her. I am actually in the process of buying my own property and will be exchanging soon but feel sorry for any potential new tenant!

It's a legal requirement for there to be a GSC for the property.

Shelter says:
You can complain to the Health and Safety Executive (HSE) if your landlord will not carry out gas safety checks.

The HSE can prosecute landlords who do not meet their gas safety responsibilities. They are unlikely to be able to deal with every complaint they receive.

If you rent from a private landlord you could complain to the council's environmental health team.

I don't understand how the building can be council owned and you are renting from a private landlord.
Are you sure it's been bought from the council? I suspect that the "landlord" could be subletting the property.
I would wait to exchange on your own property before proceeding.

Well its definitely owned by council but apparently 50% of the flats are private. I can only imagine those were tenants who bought from the council as part of the right to buy scheme.

The council will be the freeholder and the landlord bought the flat as a leaseholder. Some stuff might not be her fault eg if the leaking pipe is freeholder’s responsibility and resulting damp is causing mould. I am a landlord in a council owned block, a big leak happened back in November and the final remedial works are being done by the council this week.
She could be fined by the HSE for not doing a GSC.
I’m wondering is there anything else she hasn’t done- did she for example inform you as to which scheme she used to protect your deposit? Did she give you a “ how to rent “ booklet when you moved in? Did she show you the EICR certificate? Failure to do the above could mean she owes you compensation.

Did you get it by email? Our letting agent just sent the How to rent booklet as a PDF attachment.
