Leaseholder and noisy smoke detector

Does anybody know…?

Are leaseholders in housing associations obliged to have working smoke detectors? I live in a housing association property (as a leaseholder). One of my neighbour’s smoke alarms has run out of battery. I called the housing association as I thought it was in the hall but when they came round they said it was most likely coming out of Flat (X) which is another leasehold property. They left a spare 9volt battery with me and told me to check in with them. It’s beeping every minute, 24 hours a day and is driving me MAD; has been going for about 3 weeks now.

The question is…do I have reasonable grounds to complain to the HA and ask that they compel the owner to change the battery / fix the detector so it stops beeping? The flat appears to be unoccupied (I have never seen the owners and it’s a friendly block; have knocked a couple of times also). I also worry somewhat about fire safety and would very much like to be assured that everyone on the building has a working detector… Do I have grounds to complain? And can the HA do anything anyway?

I think try to find the lease holder and get the message to them.
If no luck you can also report to the council as a noise nuisance and they have powers to sort the issue out.
In the mean time try a white noise generator app!
