Front conservatory , permitted dev or planning ?

Hello, greetings to all.

We have a side extension as shown (pic 1) this was a garage extension (with planning), we are considering to build a conservatory style structure in the front. This will ensure we have a single front entrance rather than two that we currently have. We noticed that another house in the nearby neighbourhood (see pic 2) have done a structure that probably will meet our needs.
The structure will be set back from the front line of the house. Our neighbour are quite friendly and have no issue for us to have a conservatory in the front.

Wanted to check in this forum, if anyone had similar experience. What will be planning and building regs requirement (if any).

You may have 'consumed' your permitted development right with the earlier extension but it would appear the other house has a similar extension too.

Could you knock on the door of the house you photographed.
Say how much you admire their 'porch' and ask them how they did it regarding planning etc. ?

Any construction that changes the front profile requires planning. Having said that it really isn't as big a deal as some people make out

In our area that would need planning. Anything in front of the existing building line needs planning and if the busking line is further back in places then you’re restricted by that

plus it’s effectively a porch and a porch more than 3 square metres always needs planning

There’s information on the Planning Portal for England. Whether this would be covered by permitted development depends on its floor area, height and proximity to boundaries. Even then, local planning authorities can remove permitted development rights via Article 4 directions, so you’ll need to check the policy in your area.

Hmm - this is an interesting one.

Assuming you are in England, PP is required for anything that extends beyond the principal elevations of the original dwelling. You say that the garage is an extension (although not sure why that needed PP in the first place...) and therefore is not part of the original dwelling. As a side extension, the proposed conservatory would not appear to project in front of any part of the front of the original house, and on this point PP would not be required. It would obviously have to meet all the other pd criteria as well.

If the Council consider it a porch, then PP would be required, but I think you could argue it a was a side extension unless the door into the garage is your only front entrance point.

Look up the other house on your local authority's planning portal and see if it has planning permission.

@ShaunaTheSheep i have looked up on the Planning portal, they don't have any entry for the front porch. I'm planning to check with them @TwoLeftSocksWithHoles indicated, need to work out the narrative.

I have recvd conflicting suggestions from my immediate neighbours.

@Seeline thanks for the guide, let me review that. The house originally had a side garage, we converted the garage into a habitable place, and PP was required for that. So we have a front door to the side of the house (these are chalet style houses with side front entrance) and we have another entrance to the side garage conversion.

Our NDNs have just had something called a certificate of lawfulness for a conservatory type extension. I think the certificate basically confirms they don't need planning permission as it is permitted development. I'm guessing it's useful to have if/when they come to sell.

Ah - so if the actual garage structure is original you will require PP

I was just going to post this - a good starting point.

I checked with them today. They never took PP for the front conservatory.
