Completion date chaos- WWYD

Up until Monday, we thought we were completing on a new house on 1st November- all solicitors have agreed date, exchange was agreed for Monday this week.

Backstory is that their EA had pushed us hard to make the earliest possible date as they were desperate to move and under pressure from their vendors (top of the chain).

We then get added to an email chain where the EA tells all the solicitors to move completion to the 18th. We can’t do this, we have both a holiday and essential business trips booked in the 2nd two weeks of November that were rescheduled away from the 1st!

I call the agent, turns out they have booked their dream holiday and therefore can’t move. Apparently he’s known about this holiday for months but “assumed” that they would be back in time. God knows why their solicitor agreed this completion date.

I explain that we can’t do the 2 weeks end of November as we have pro-actively moved our travel arrangements away from the originally agreed date. I basically tell him that we are ready to go and can do anything before the 11th or after 24th. He comes back with “14th/18th or the whole deal is off, they’re annoyed about the gameplaying….” Errr what gameplaying?!

I remind him that I’m copied in on an email from their own solicitor confirming the 1st not 48 hours ago and then he tells me a sob story about the vendors shouting and swearing down the phone at him. I tell him we need some time to think as my DH was in a conference so wanted to wait for him to get home that evening to discuss (it’s his business trips). My proposal of 21st November was rejected as “too close to Christmas”, others were rejected because “Fridays don’t work for them”. At one point they suggested we complete but that they didn’t move out for “another few days”.

He called me a further 3 times that afternoon trying to force me into various dates when I asked him to wait for us to contact him the following morning, including calling me 20 mins later with “oh sorry, I butt dialled you, but as I’ve got you, any confirmation on date?!” WTF??

at that point I contacted our solicitor who reconfirmed that the vendors had now said 14th or nothing.

the next day we went back and confirmed the 14th but reiterated it was at great inconvenience to us and if they moved it again we would reconsider the purchase. Our solicitor also phoned the EA and told him he was not permitted to contact us again- all correspondence was to be made through her.

that was Wednesday… they haven’t come back and agreed the 14th so there is still no exchange possible.

AIBU to consider pulling out?! They pushed and pushed us to get it through ASAP and we’ve pushed our broker, solicitor and any arrangements to make this work to suddenly be met with stalling, delaying and bullying?! I’m not sure they’re even committed.

we currently live in a tiny 1 bed with a 1% mortgage. We are buying a 3 bed detached on a 4% mortgage, lots of character and “fully done”. Desirable SE market town where this kind of property gets snapped up. Plan is to rent out current house to buy this one to live in.

What does your solicitor think?

Does this mean you'll have to move your holiday again despite already moving it once? If so, they should compensate you for any fees you're charged to move your flight etc. If they refuse, I would definitely play hardball and threaten again to pull out.

Oh hang on, I missed that. What the PP have said - if you're renting your flat out, there's no rush to move on completion day.

Can you not just complete whilst on holiday if you're not having to move in straight away?
A friend completed on a property whilst we were on holiday in Lanzarote. Was just a quick phone call to confirm all good to go.

Ahhh looks like I’ve lost a post,

the only date they will agree to is the first date of the travel plans meaning we could not view the property let alone move in for a further 2 weeks.
As well as no longer trusting them to actually move out, due to their threats and therefore wanting to be there to check, we also require our house to be empty to complete essential works before we can rent it out, therefore it does cause us delay and cost due to now needing to move the dates the contractors are booked for and not being able to let the property out until they are completed.

Right, first thing is you're not dealing with rational people so don't look for sense in anything they say. Next, if you're renting your place out why do you need to move on the 1st? Is it to get it ready to rent? If you delay there is a cost attached. You can ask for that as compensation. Or, and this is by far the easiest, exchange on whatever bloody day they like and pick up the keys when you get back from your trips. It's going to make 2/3 difference of chuff all in the long run. Smile, nod, buy the house, forget them.

I’m here getting so confused about why they pushed so hard, only to start stalling and faffinf!

but yes- work required on our house which also needs moving etc.

I think you should hold on. If you don't need to move out of your flat then really you have options. It's annoying but you're not going to be homeless. Can you exchange before you go away and then complete when you're away and move in when you come back?

Saw your update. Talk to your contractors, make sure they absolutely will be starting in the expected day because let's be honest they tend to be a bit lax on letting you know of delays.

Is there any chance that the vendors are trying to get you to pull out, but they could call it off themselves? Can't think why, unless you're in Scotland?

What rate will yours go up to when to changes to a BTL mortgage? 5% ish? Is that still affordable? Have you got this agreed and all the affordability for BTL done- as it is based on rental value and your tax rates rather than how much you can borrow.

@washingbasketqueen this is what we wanted to do but they have said 14th or no completion at all. Basically 0 flexibility from them whilst wanting us to shoulder significant inconvenience.

They get home from holiday on 8th, we requested 11th to allow us the weekend to get sorted, they replied “we don’t do Fridays, so we can complete but won’t move out until Sunday”!

BTL is fixed for 5 years at 2%, residential is 5 years at 4%. Our current mortgage is 1% for another 4 years so if we don’t get this house we will simply stay put unless something amazing comes along- we could be mortgage free by the end of the fix, it’s just an absolutely tiny house.

@DogDaysNeverEnd not in Scotland but this is what it feels like to me, that they are no longer wanting to proceed but want us to be the bad guys.

id be annoyed but just get on with it and suck up any extra costs

Very interesting to see the number of people who would suck it up despite all the threats and hassling!

Maybe I am a drama llama! It’s just SUCH a hassle to reorganise everything, especially things that we have already moved once to commit to the first date!

Can you ask them to cover your packing and moving costs for the inconvenience as you’re slammed with work? Would make things a bit more pain free?

You've got different answers because we've heard this for five minutes and can think of the long term goal which is buy house. When you're in it however it's usually been months of hope, fear, anger, confusion and despair. It can be very hard to focus on the end goal when it's been such a difficult process to get there.

I wouldn't complete and not be there to physically check house as it's your responsibility from then on. We completed in the summer (planning building work and in rental so not moving in immediately).

There was a delay getting the keys so I didn't get round there until the evening - vendor had left back door unlocked and windows open! So it had already been left insecure for several hours. Fortunately the gas etc hadn't been left on so just a security risk.
