Building reg&restrictive covenant indemnity

Hello!

We're close to exchange and my solicitor has raised this with the seller - is it fairly common/ straight forward? It seems it gets organised by them but I hadn't heard of it.

I think this is common. We bought a house that, when built, had a restrictive covenant about the style of fencing they were allowed, and some other bits and pieces that I've forgotten. In the intervening decades, the fencing had been changed. The indemnity insurance was sorted by my solicitor and just meant that, if someone decided to enforce the covenant, however unlikely that might be, we were insured.

Yeah indemnity insurance in general is available for a lot of things. They are very easy for the solicitor to buy online and charge the seller for usually. It only covers you if the council enforce action. It doesn’t cover you if the thing it is bought for fails/is unsafe etc.

I wouldn't accept an indemnity policy in place of a building regs certificate if the work was done in the last ten years or so; as a pp said, it doesn't protect you from shoddy or unsafe work. Selling might prove difficult without the proper certificate.
