selling & retaining land

Hi all,

we are 11 weeks into purchase, 3 houses in chain - we are all ready to exchange but top of chain is delaying this due to thier sale. They are selling some land & retaining some, so the solicitors have to ensure correct titles are on the land etc. we was informed of this a few weeks ago and so far no further update on this, not sure if they just have very slow solicitors, apparently its nothing to do with land registry just solicitors & paperwork - has anyone had any experience of this or has any advice they can give on it, we will be hanging on another week or so and if no update we will state that we would be looking to look elsewhere as our mortgage expires December, why can't they just sell all the land, it's just making things difficult and delaying everyone, surely at some point the Estate agent has to put some pressure on them and explain the impact it is having on the whole chain. Also I am aware that chains can take longer than 12 weeks but we and others are all ready to go aside from the top so thats why I am now wanting to put pressure on at this stage

With the kindest of intentions, you're posting on this subject (with a slightly different slant) very frequently. I think I've seen at least four separate threads.

I'm guessing you're short on replies because people just don't know. The whole house buying thing is tedious and difficult and very individual. Chasing up with solicitors and sales progressors is your only chance of finding out where you are.

I wish you the very best and hope it all gets sorted soon for you.

“Why can’t they sell all the land?” Dunno. Maybe they want to keep a garage or something?

It takes time as the transfer of part document can be complicated and needs to go backwards and forwards between the solicitors until the exact wording is agreed.

a straightforward sale not involving a chain takes about 12 weeks, it's just a normal amount of time for searches etc to come back.

everyone else in the chain will be aware of this and not getting agitated. I could understand the anxiety if it was the end of November but it's not.

If you aren’t happy pull out. They have every right to keep some land, for any reason.

Thanks for your replies, I am on the side of anxiousness yes, wanting to be near family asap due to personal reasons and due a baby very soon. I shall hold tight and make contact near end of week with solicitors for an update if one.

Ask the EA for a weekly update on sale progression.

Buying / selling is a long drawn out fraught process. No need for alarm at this stage.

It is worth telling the chain that your hard stop date for completion is X (eg: mortgage expiry date - 7 days) and that you will pull out if it looks like the sale may go past that date or you haven't exchange by a certain day.

It might focus some minds further up.

Thank you, its a little frustrating because the solicitors are being quite vague with the info they are giving the EA so we are not getting much info. if we had some rough idea of how long we could be looking at I would not be freaking out so much

@TheNoonBell thank you for your reply, we are going to say to them end of October, that might seem a bit premature but with the baby on way and things we dont want things all up in air last min, everyone else in chain has been ready and waiting for a good few weeks apparently. also I don't want to count December, I heard so many people say that due to it being the festive period month so much annual leave and solicitors seem to go on even more of a go slow at that time.

December is spent dealing with clients who are desperate to be in by Christmas. We’re not on a go slow.

The comments on this thread are not going to be different to the other threads you've asked the same question on OP. You will annoy your own vendor with continued threats to pull out though.

@ChicCroissant thank you, we haven't made continuous threats we are planning for the first time to give a deadline of when we would like to be in as others advised to
