Hello ,

so we are aware that the person at the top of the chain selling their place has enquiries going on which we were told should take a few weeks, however informed yesterday that they are only selling HALF the land with the house and keeping other half, the EA told us that they haven't had a surveyor out yet, nor has land registry got involved yet, we are 10 weeks into our process and we are all ready to go with purchase, the person at the top is now causing this delay

googling it, it says changes to LR can take 6 months or more?! I dont know if anyone on here has done anything similar when selling their property and land, our mortgage expires in Jan, just concerned this is going to take a very long time and wondering if best to pull out and go for something chain free?! we are FTB this is all new to us and quite stressful at this point haha

not sure what my question is here, more of a rant, especially when we were told by our solicitors everything is fine and dandy and then hear from EA something totally different, Solicitors said they dont get involved with top of the chain....

How much you can do about this may depend on how close you are to the top of the chain. But the Land Registry can ‘expedite’ applications (eg to divide a title, or whatever is needed here) for a fee, if the applicant can prove that other sales depend on it (which presumably they can).

But the pressure to do that will have to come from whoever is just below the top of the chain, and if that’s not you then you will feel quite powerless! The Land Registry have a helpful thread on one of the money saving expert forums, which can update you on applications, but to use that you’ll need the title number of the top of the chain.

If they are retaining part of the land then they should be able do a sale of part. Shouldn’t hold the chain up as nothing needs to done prior to the sale. Just a different form that needs to be used for the transfer TP1 rather than TR1.
