Thought our purchase was chain free

Ok so this sounds ridiculous but we had an offer accepted 19th july foe wgat we thought was chain free, we are FTB we thought the vendors were selling and moving into a property that was already vacant etc, when we just looked back on listing to check a pic of one of the rooms it says nothing about chain free, we phoned EA to check they received some gifted info we sent them and asked them they said its with sales progression team and we will get an update tuesday, we have been liaising well with solicitors we have signed contracts, mortgage in place, searches back with no probs but in my head I thought oh exchange will be soon hopefully now I have found out its not chain free I am freaking out something is going to fall down and mess this up! Hmm..

Because the sales progression team would have to be involved even if it’s just you and the vendor in the chain.

Gosh that was hard to read, please stick some fullstops into sentences if you can. Why did you think it was chain free? Who is buying the vendors property, or have they already sold it. I am sure you will be fine but its unlikely is chain free if vendors aren't currently living in rented accomodation.

You don't know it's not chain free, you're just panicking. It's understandable but just wait to find out on Tuesday and try not to panic. We're 6 months in since originally selling our house and still haven't moved so I get your panic but it might all be fine.

The OP is buying the vendor’s property.

I had this last year. I was being pushed by my buyers to complete quickly because of stamp duty freeze …I was pushing with my vendors to do same so I could meet deadline
they were dragging their heels for weeks…then suddenly with 4 weeks to go till stamp duty deadline started on at me for delaying things…wtf …I was the one doing all the chasing between mine and their solicitors , including fact they’d switched solicitors 5 weeks in.
I finally asked vendor why they were suddenly hassling me about it given they were moving into parents house and not purchasing just yet. Suddenly told they had put an offer on house and n9w wanted to benefit form stamp duty freeze. There purchase got delayed and all sorts of issues , they suddenly said they couldn’t complete until after stamp duty freeze.
i complained to EA with docs and through my solicitor to show they’d committed to move asap into their parents and they were breaking that agreement. Basically I said that I would be in a position of missing stamp duty freeze and my vendors would, and they’d have to pay compensation.
we made it in the end with 5 days to spare.

it seems currently people talk absolute bullshit about their chains…probably due to the lack of houses for sale and all the delays still with purchase process and solicitors. You have to take it all with a pinch of salt and allow worse case scenario or get it in writing as condition of offer

We had this. Do you have it in writing that it's chain-free? We were told at the viewing that it was, and we stupidly believed the estate agent!

Our solicitor then did put that the vendor was actually having to wait for probate to be granted on the property he was buying. So, yes, the property was empty, but he wasn't chain-free! Unfortunately we didn't have anything in writing to confirm what we'd been told so nothing we could do other than use it as ammunition to hassle the EA with as the transaction got slower and slower!

This happened to me. Advert specifically said chain free. I also was not in a chain.

They were inexplicably dicking around. Turns out they had wanted to sell and move in with her parents to put them in a strong position for buying, but had found somewhere after receiving my offer. No longer chain free and my purchase was delayed by messing about with their purchase. I was fuming.

Then on the day of the move it was gone 6 before they left 🤣 just to top it off. CFs.

The vendors are waiting to move to another property. They are only chain free if that new home /property already belongs to them.

If they are buying it , even for cash, then they are tied into a chain of other peoples conveyances upstream and are not chain free.

You are paying your solicitor to serve YOU. Your solicitor should show you any paperwork you request to see .

The estate agent is employed and paid by the vendors to serve THEIR interest and instructions. He doesn't work for you. You are not his clients.
