Factoring and Shared Costs

Any property/factoring experts out there? I am in a flat, made up of 8, within a larger estate. As part of the deeds we must have a factor in place who arranges all the cleaning/garden services etc. We don't like them but accept they have to be there.

The flat above me is owned by an idiot who in the past has flooded my kitchen completely and my bathroom a little on one occasion with little in the way of apology, but this is irrelevant to the next bit.

We (block of 8) got an email from our factor stating that the owner of this flat has damp in a corner of room and around the windows caused by multiple boss and cracked areas on the exterior of the property. To fix this the affected area (5m2) will need to have the hurling removed and redone at an estimated cost of nearly £3000+VAT, which is about £500 each.

I do not have damp issues and neither do the flats below me.

Any advice on whether we are duty bound to pay this or any good questions we should be asking. A couple I have is 1) where are the other quotes (just seen one) and 2) how is there damp when there are been hardly any rain for months and we have a water shortage.

Any clues or guidance much appreciated.

Yes, I think you’ll have to pay. You’re not paying to sort your neighbour’s damp, but for common repairs. You can ask for other quotes, but your factor may have a framework agreement with a contractor for amounts below a certain level.

Thanks. I suspect that might be the case. But the quote will be challenged, that is a ridiculous amount for just part of the wall.

Well, the upshot of this was the factoring company agreed to get other quotes. Heard nothing for months but it later transpired these builders did not see anything wrong with the wall.

Rep from the factoring company went round to the flat and concluded there was more of a 'lifestyle' issue which caused black mould over the walls and windows. £600 (at least) saved 😀
