Selling our house but have to disclose neighbour dispute

Hi, we are selling our house and we’ve just accepted an offer… unfortunately on the solicitors forms, legally, we will have to disclose a dispute we had with our neighbours over noise (they kept having loud parties) and which went to the council (they are social housing tenants) and then to mediation. This was three years ago and it was resolved and we haven’t had any cause to complain since then. Still, I’m concerned that when our buyer sees it on the form, she might be put off. It’s making me very anxious. Just wondered what people’s thoughts are.

Yes it would give me cause for concern and I would ask questions. I’d be somewhat reassured that there had been no incident for three years.

Sorry OP it would put me off too, I would assume that they may go back to their old ways once you've gone and that I'd have to start the long and painful process from scratch after I move in

I wouldn't necessarily be put off, especially if it were >3 years ago.

I would pull out. I’m sorry, I know that’s not what you want to hear, and your buyer may feel completely differently.

Thanks all. We do have the opportunity to sell to a BTL investor instead. Do you think they’d be less bothered by the past dispute?

We knew that the owners of our current house had issues with noise from next door before bought. They didn’t declare it in the forms, we only found out from other neighbours- apparently there was no love lost!

Similar issue- constant parties every weekend until the early hours while our vendors were rearing their three kids. They were infamous in the estate for police land rovers being out to the house every Saturday night.

We bought the house anyway and honestly never hear a peep out of them, so people can change their ways!

Would completely put me off. I’d never buy anywhere with a history of neighbour noise. It’s already a gamble when you move somewhere new.

That's a shame, but I wouldn't touch your house with a barge pole. I'd be concerned the neighbours will go right back to their old ways once you are gone.

Out of interest how long ago do you have to report past problems? , is 3 years not a suitable enough time?

I would think a BTL investor may be less bothered.

Surely 3 years with no problems since the dispute was resolved is enough? Would the neighbours start up again with a new owner?

Just make sure you mention it was 3 years ago and resolved. No issues since then.

I'd be worried if it was an ongoing dispute. Not so bothered by a historical one. When buying anywhere you could have a nightmare neighbour move in the next day

No. You have to report any dispute, whether you reported it to someone or just kept it between yourselves.

Sorry but I would pull out over this. I imagine a BTL investor would be slightly less concerned but they still might ask for a reduction on price when it comes to light 😕

BTL investor won't care, as the problem will be the tenant's.
