Hello,

We are a family of five living in a one bedroom first floor, council flat. We have three children (two of which have a diagnosis of ASD), all children are under the age of ten. It has been very difficult for us as we cannot afford to rent in the private sector, DP no longer works as he was made redundant and is still continuously seeking employment which is proving really difficult. I don’t work as I am the full time carer to my children.

The neighbours below us are a lovely elderly couple of whom are disabled and the DH is dying due to poorly health. We are constantly apologising to them because of the amount of noise the children are always making, honestly it’s just so heartbreaking, we really don’t know what to do with our situation, we are clearly overcrowded and this is having a huge impact on our whole family unit, due to lack of space, sleep deprivation as one our DC has other underlying health issues which keeps us up most of the night, amongst so many other issues which is just very overwhelming for the children.

The Housing department have basically said that there is nothing that they can do for us and have gone as far as making this one bedroom property our now “permanent accommodation” as we were previously under the “temporary accommodation” status up until last month. We have been living in this property for the past six years. The condition of the property is also not good and after having approached the Citizens Advice Bureau (CAB), it’s evident to see just how serious and very real the housing crisis is almost everywhere. I just can’t help but think that there must be some help out there somewhere.

I would be very appreciative of any recommendations for any services, organisations or good Solicitor Firms specialising in Housing Law.

R u currently renting privately or council / housing association? Or is this just temporary accommodation?

The reason I’m asking is because I’m in a very similar situation as you I’m classed as overcrowded but not as overcrowded as you. Both my children have asd and literally cannot share a room . What advice did cab give you ? Maybe you have already done it , have you applied under medical grounds on the housing list ? I was advised by cab to write to my local mp who wrote to the local housing mp who helping to get me rehoused .

@Chocolatesandroses CAB basically advised the same in that we should approach our Local MP and present our case to her, ensuring that we express our concerns regarding our housing situation. Otherwise in all honesty CAB really couldn’t do much in terms of providing support.

We haven’t yet applied under Medical grounds, reason being that we tried to approach them with this a while back and our Tenancy Officer wasn’t very helpful at all, in fact she basically dismissed this challenge saying that there are many individuals in the same circumstances as us and therefore it really wouldn’t over turn anything.

We have however written a letter to our Local MP and gathered some photographic evidence to illustrate the unsanitary conditions of the property throughout, school have also written a letter and we are awaiting a letter from GP to send everything altogether and see where this leads.

I found cab gave good advice in my situation anyway . If you apply on medical grounds to your LA your get higher priority. I was band 3 I went on medical grounds to priority 2 . They will try and put you off but don’t listen keep fighting it . This really annoys me they keep saying to me lots of people are overcrowded but I’m only classed as overcrowded because I have a boy and a girl over the age of 12 but even if I had two children same gender and ages I would still be asking to be moved . A lot of ppl will say that mp won’t make a difference but I found he has helped a lot . Good luck op, sorry I wasn’t much more help .

How many of you were there when you moved six years ago? Why did it change from temporary to permanent accommodation? Can you work during school hours? Can you move to a cheaper area?

@JustTheOneSwan We haven’t contacted Shelter, in all honesty didn’t think we could contact them about this kind of situation but thank you for this recommendation, will be sure to contact.

@Celeryfavour When we first moved it was only three of us (Myself, DP and DD) and at the time the property was allocated to us as a five year flexible tenancy, we then received correspondence last month informing us that as the period of five years has now ended, the Council wishes to grant us a secure tenancy pursuant to the Housing Act 1985. Further went on to say that this does not affect our rights to live in the property and that we must continue to abide by the Council’s Conditions of Tenancy.

Unfortunately I’m not able to work at all due to the severe nature of my DS disability.He is also not in a setting and is currently awaiting his Draft EHCP to allow for him to be able to attend a suitable specialist provision.

Op I forgot about them contact shelter as well they are really knowledgeable on all sorts of housing not just homelessness. I used them before when I was having issues with my HA regarding a mutual exchange. They have a online chat

Would it be easier for you to get a job? Can your husband wrangle the kids and you work.

What was your plan for future housing when you grew your family?

Sorry to hear no one came back to OP. Give it 4 weeks ,if u haven’t heard anything back , mps have surgeries you can go too , maybe call to find out when they are and speak to them about your situation
