Renew Tenancy Forced to Move Out

Hi,

My daughter rents a flat at university with one friend. Her friend is returning home as she is graduating. My daughter is staying on for her final year, and is going to stay in the flat. Her other friend, will be moving in at the end of the tenancy.

The estate agents are very happy with how the flat is being kept, and rent id always paid on time etc. No problems. Agents were happy for dd to renew tenancy, but when they found out it would be a new tenant, they became awkward.

They say that due to problems with the deposit scheme in the past, they will have to treat the new tenant and dd as a completely new tenancy. This is to avoid any disputes about potential damage and liability between tenants.

So this means that dd will have to move out of the flat for a week, and then move back in. Nothing can be left in the flat, and it needs to be cleaned to the same standard as before, eg a professional clean.

Has anyone else heard of this? Absolutely crazy

Dd is keen to stay on in the flat, as it’s very hard to come by. Demand is insane here.

This is correct. However, I don't see why this should take a week. Yes, the flat needs to be thoroughly cleaned to get it ready for the new tenancy, but it should be possiblt to do the changeover on the same day.

I suspect the 1 week move out and move back in requirement is for the convenience of the estate agent. All your daughter can do is try and negotiate with them.

It is a new tenancy, as the first one was a joint tenancy but could continue with just your daughter. However she wants to start a new joint tenancy with another person.

NB: Does your daughter have the LL contact details? As a LL I'd be miffed if I lost a week's rent because my agent can't get their act together. Maybe talk to them direct?

And I'm wondering whether the EA wants to charge the LL another fee for finding 'new' tenants. This can be as much as 2 months rent...

contact landlord direct - the landlord would have to pay new fees if thye do this if they continue tenancy they wont
