Do estate agents have to tell prospective buyers about failed surveys if they ask?

I bumped into a friend who I haven’t seen in years today who mentioned she was going to view a house.

It transpired that it was the same house that we had pulled out of a sale for because the survey was shocking. Woodworm, wall tie failure, no building regs for extension, damp, historical subsidence needing specialist insurance. We shared with the estate agent who said no renegotiation on price and walked away.

I suggested she asked the agent, if they knew of any issues in the previous survey and they said no. Our sale fell through due to a change of circumstances!

Im livid but I also thought this was illegal now? It was the same agent I dealt with so she definitely knew. It just feels so wrong!

I would put the reason why you pulled out in writing to the estate agent. That way there is a paper trail. AFAIU, the estate agent is required to answer specific questions to the best of their knowledge. If the agent is a member of the FNEA, I would report them.
