Who is responsible for this tree? - Diagram! ✏️

The tree on the left is at the edge of the garden of Neighbour A.

The tree’s branches hang over a public right of way, and they extend into the garden of Neighbour B.

Neighbour B would like the side branches to be cut back.

The tree is very tall.

What should Neighbour A agree to? And, who funds it?

There’s no particular problem with tree roots if the foundations are deep enough. That would depend on age of house..

What if a tree surgeon requires access to the tree on person A's land to remove the branches, can person A object if person B is paying?
I have aver similar problem, a huge tree, in a residential area. It overhangs my garden, fills it with dead leaves and seedlings. I want all the branches that overhang removed and A refuses to allow access for this to happen because the surgeon needs to climb the tree from her garden because it's behind a six foot wall.

You can't remove whole branches that overhang, just the parts of the branches that encroach over your boundary. The owner of the tree does not have to allow access.

You also cannot unbalance a tree. Cutting off branches on one side isn’t great for the tree. You just have the right to trim back what overhangs and this can sometimes be done safely from a scaffold tower on your land.
