Mortgage/ inheritance- property transfer. Anyone DIY’d it?

I have (sadly) inherited half a house. There is a small mortgage on the house (too small to remortgage, it would have to be a long term loan).

The mortgage company don’t seem bothered that the mortgage is now solely in the name of the other joint owner so I guess it won’t be an issue adding my name to the deeds?

The mortgage is due to be paid off in two years so could we wait until then to change title deeds? I will eventually inherit the other half too. We have probate.

Has anyone carried out transfer of title themselves in this situation? How easy was it? The solicitor has quoted several hundred ‘plus disbursement’ which I think is one form!

Im going to assume that it’s your parent who has died and your sibling lives in the house with him/her.

I confess I know nothing of these things so basically bumping for you.

I presume there is nobody else who has a claim on the house? Does your sibling and you get half each?

If the sibling who lives there has been working and that’s why their name is on the mortgage they will have been paying towards the mortgage so they will be due more (ie the bit they contributed) than you who hasn’t contributed and just gets your half of what the parent contributed?

Do you work and could you get a mortgage? As you and your sibling will now presumably take over the monthly repayments. So presumably you need to half in from now on for that and maintenance etc?

Is the co-owner resident in the house?

I would get your name on the Land Registry ASAP.

Legal detail is for when things go tits up, the unexpected. The resident half owner could beef sudden urgent care, and the LA put a charge in the house. They could go bankrupt. Re-marry….

And you have no control over a will leaving you the other half. It could be changed.

Tbh the money for a solicitor sounds well spent to me. Having half the house left straight to you potentially saved it being swallowed up in care fees.

I would ALWAYS use a solicitor to transfer any share in a property. It isn't as simple as you might think, and lots can go wrong. Don't wait. Get it all sorted ASAP, for the reasons given above.
