I feel like my estate agent is not acting in my best interest

I put an offer in for a house with an estate agent. It was considerably over the home report (in Scotland). The sellers are moving abroad and being set up by their company over there. They are flexible on dates and don’t have a definite date of moving although said the sooner the better.

I then got a few estate agents out but the estate agent that were selling the house I am buying were very keen to sell my house too. They price matched another estate agent (reducing their original fees considerably).

Now I feel like they are pushing me to accept an offer as the buyers are ready to move without a chain. It’s not above home report and I’ve had a number of viewers verbally tell me they will offer over home report. One viewer told me that the agent said we would probably not accept an offer unless the person has sold. This is not true.

Our aim is to get as much for our house as possible particularly as we’ve over paid on our new house. The agent seems to want to appease our sellers and move in January instead of accepting a higher offer and adjusting the date to February/March (which the seller told us would be ok when we viewed the house.)

I’ve emailed the agent and told them we want the highest offer not the soonest moving date but I’m worried they won’t pass on offers. The agent was very keen for me to accept the first offer we got which is lower than I wanted but with a quick moving date.

Have the viewers who verbally told you they’d pay above the Home Report actually communicated that to the EA? Your EA is legally bound to pass on all offers so will be in breach of contract if they don’t (I’m assuming this is also the law in Scotland as it is in England).
