Neighbours builder has 'damaged' my wall

My neighbours builders (detached) have knocked down part of my wall, very neatly and removing only about a bricks worth of my wall which forms the while removing his wall as he is tarmacking his drive.

There is now a gap.
Neighbour didn't ask me or tell me he was removing part of my wall, obviously I want them to put it right - the colour of our walls are completely different - but should I have been asked about a party wall agreement?

I didn't even take before photos as it didn't occur to me that my wall was being removed too!

Pretty sure they needed permission and it's total CFery.

Kick off massively about this. Totally out of order. They need to put it back as it was before.

LaBellina · 30/09/2021 09:54

CF of the highest order.
Time to stand up for yourself and demand they fix it back to the state as it was before.

Use the legal cover on your house insurance to get a legal letter written to restore your wall. Are they trying to grab some land?

SuperStarRose · 30/09/2021 10:07

They are allowed to remove their half of the wall without even consulting you. Strange but true.

As for the the damage they're obviously not allowed to do that so you can appoint a relevant solicitor which they then have to pay for and then they will have to repair your part of the wall.

SuperStarRose · 30/09/2021 10:10

They only need to consult you re party wall agreement re any loft conversion and if they were to remove all of the wall in your case.

You are always allowed to appoint a solicitor that deals in these matters which they have to pay for.

SuperStarRose · 30/09/2021 10:11

Not all but any part of your wall on your side which they obviously have done as you have a gap

Google maps and street view may well help you here.

Thanks @GunsNMoses - I hadn't thought of that!

I would go nuclear! Some neighbours are absolute shitpigs.

Get a solicitor as other posters have advised. NDN will have to pay the legal costs plus the cost of repairing your wall. If they refuse "letter before action" then take them to court.

The only problem is there is a possibility I want to build an extension up to their boundary in the future - so I don't want to go to hard otherwise they will take their revenge at a later date!

Just wanted to know my rights and whether they should have sort my permission and issued me a party wall agreement?

Not a party wall issue. Possibly a boundary dispute!

PenguinWings · 01/10/2021 16:06

It does sound like a party wall act thing to me, like many people I thought that the party wall act only applies if it's a party wall, but it's to do with boundaries as well.
