Could I be liable for husband mortgage debt?

I am scared to consider buying a property with my husband.

We currently live in my property which is owned and mortgaged in my name only before we met and before we got married.

We need somewhere bigger but husband jointly owns another property on an interest only mortgage that he is trying to get sold through the court (already got a court order to sell it and he has a buyer) but the other owner is trying the block the sale.

If the worst happened and my husband was trapped on his other property until the end of the term with the other owner refusing to move and the lender come after him for the full outstanding amount, could the lender come after any property jointly owned by me and him if we did buy one together?

I sometimes think we will be stuck in my tiny house forever as I am at too much risk if I buy a property with my husband.

No I don't think so as the mortgage would be secured on the other property. But it does complicate things though as he would be trying to pay two mortgages. It would potentially effect your eligibility for a joint mortgage. Can you access any free legal advice to check this out properly? Union? Work?

Like the pp said, the bigger issue is likely to be him not being able to get a mortgage with you as he’s already liable for half the payments and outstanding amount on his existing property. If it is with the court I think I’d try and hang out until he was free of it.
