LVT Flooring - Small claims court

Hi all,

Just hoping from some advice with anything with experience going to small claims court.

In September 2019 we had lvt flooring installed, self levelling the floor was already included as they advised this was crucial to do before laying the floor. We went ahead with the quote for self level and lvt flooring, after they installed it there were some areas which bounced a bit but was told this is normal and would settle over time.

As I should have expected, it got worse over time. The floor now cracks when you walk over it, isn’t level atall and gaps have appeared. I first made the contractor aware of this in July 2020 as it started to get really bad. Got told someone would be out to fix it, they didn’t show numerous times then eventually did to have a look he did a temp fix of one part and said he would come back to fix the rest as he needed tools, obviously he never came back and ignored all my messages. I was messaging for months and they were being read but ignored.

I found another Facebook of his and messaged this week as I could see he was posting thing, he said he would send someone out this week and surprise, they didn’t show up. I messaged and said we will now go to small claims court, he said he would send someone tomorrow and I declined as this had been promised and let down everytime for nearly a year.

The price for the work was £1600 our builder (he has worked on other things for us since) has quoted £6600 to uninstall all the flooring and re self level and lay new flooring. As the previous self level was so bad the whole floor will now be raised which means we will need new skirting, kitchen kick boards to be trimmed and doors to be trimmed.

Should I be submitting a small claims for £1600 for a refund or £6600 to cover the new builders work to rectify the issues.

I think you need to get in writing that the existing self levelled floor can’t be removed and then you can make a claim for the £1,600, removal of the old floor and the modifications you need to make to accommodate a higher floor level. You wouldn’t be able to claim for the cost of levelling or laying the new floor because you’re being compensated for that with the £1,600. If the old flooring can’t be reused and you paid for that, you should be able to claim for that as well as it will need to be replaced.

It’s laid all wrong it shouldn’t be staggered like that for a start. The builder is completely taking the mick, no way would it cost that. You need to contact NICF or floorskills as they will be able to provide someone fully qualified & independent to do a full report for you. Shocking.
