URGENT! Was due to complete at 12, Yorkshire Building Society haven’t released funds due to “system error” on their part and are refusing to help...what can I do?

Posting on behalf of a relative.

As above, sale and purchase were due to complete today and she has removals men due any minute - however, Yorkshire Building Society have not released her funds due to a ‘system error’ on their part and are saying there’s nothing they can do about it. Has anyone been in this position before that can help please? If relevant, this is all in Scotland. Many thanks!

A swift google suggests they have IT issues today.

Your relative needs to speak to her conveyancer who will have seen this (or something like it) before.

Have you exchanged? If not, it won't cost your anything but your removal costs. If you have, then you'll be liable for the fees of others in the chain.

OP says the transaction is in Scotland so it's a different system to in England. I think they will be committed to completion today.

What has your solicitor said OP?

Yes, they’re committed to completion today. Both solicitors are being sympathetic and are awaiting an update once YBS call my relative back, which they said three hours ago they would do and haven’t yet.

When this happens in England, if the chain is short, solicitors can cobble together agreements between the parties to allowing the buyers access. It's terrible, esp as the banks will be working through it and you just have to wait and i should imagine your solicitor has been on the phone non-stop but there's nothing they, or you, can do about it.
Start working on the sellers, asking if you can have access via a key undertaking or similar...and good luck. This is terribly stressful and I guarantee your solicitor will have spent 5 hours on this alone today - so buy them gin when all is settled.

We had the same scenario (also in Scotland) except the fault was our lawyers. He couldn't pay up to complete the sale because he hadn't received the money from mortgage lender; and that was his own fault because because he had ignored their repeated requests for bank transfer details.
Completion day was also moving in day; so the seller's lawyer refused entry. Our removers and DH were en route from England, completely unaware, and could not be contacted; I flew up with the baby and discovered the mess on arrival.

   I rang our lawyer and told him  the baby and I were coming to live in his Glasgow offices and make his life hell.  To avoid that he hurriedly  transferred the entire house price from his own personal bank account to the sellers lawyer. Problem solved.

The solicitor said at 3:30 that even if the money arrived it would be too late in the day for him anyway. Don’t think he’s topping her list of people to buy gin for! Fortunately her buyer didn’t need access today so she can move tomorrow assuming the funds arrive tonight as the bank say they will. Thanks for your help all.

Not all solicitors are lazy shits, of course - do watch those MN absolutes. Nonetheless the op has one and I came across quite a few when I was scouting out one to do my house sale and purchase. The high street old family firms are particularly bad for over charging and slow response. Naturally you don't want a super cheap body shop either. A solicitor doesn't need to be local, I used one 200 miles from all the transactions and they were great. Quick, responsive and knew how to delegate if someone was absent.

Used them again a couple of years later. Still just as good.
