Will a lender give a mortgage on a property with no PP for an extension more than 4 years old?

Hi all

I'm actually losing my mind this weekend! We got PP for our extension but didn't see one of the conditions. Selling now and it was picked up.

I've been told we can't get indemnity insurance because the buyers solicitors have made the council aware and I have been in contact with them too!

But as it is more than 4 years old does anyone know if lenders would sign off on mortgage for our buyers?

I was planning to apply for retrospective planning but our sellers will remarket if we do this.

It will probably depend on the buyers and what % mortgage they need, and how pragmatic the buyers solicitor is

It’s the sort of thing that a first time buyer would be an absolute nightmare about but a 3rd/4th time buyer would probably work with you to find a solution?

I’m slightly clouded on this because I’m only ever had a nightmare when selling to first time buyers - wanting FENSA certificates or indemnity policies for Victorian sash windows etc

When we bought our current house, the mortgage company did a desktop valuation, DH surveyed it himself and the mortgage company didn’t appear to do anything to cross reference previous planning permission with the actual works done, but we didn’t have a huge LTV

What’s your buyers situation?

They are FTB but very much not bothered about the planning issue. We've got certificate of completion and a good building survey. And the condition we missed was really very odd!

35% deposit apparently.

And what is the planning issue?
Small difference in materials, or you whacked in an extra few metres?

Has the valuation been done, and who picked up the planning issue? Their solicitor or you?

Buyer's solicitor picked it up.

It was a condition that we had to have a contamination plan. There was a petrol station next to us some 15 years ago I think. Though our environmental search when we bought the house says there is no contamination risk.

Is that a plan in case of contamination or a plan to manage actual contamination?
