Going from rental to buying... notice period?

Sorryusernamealreadyexists · 13/04/2021 07:08

We are currently buying the house we rent. Do we have to give notice on the start date of the tenancy (27th) or can we give notice on any day as long as there is a month between those dates?
If landlord wanted money earlier, could we complete in less than a month?

Thanks Flowers

Couldn't you just sit tight? Surely it won't come as a surprise to the landlord the house is being sold.

firebrimstone · 13/04/2021 07:52

I surely just pay him the months notice once you've exchanged?

Shouldbedoing · 13/04/2021 08:01

If you can afford to have the rental overlapping with the house you buy, don't underestimate the joy of having the chance to move in gradually, paint empty rooms etc

Shouldbedoing · 13/04/2021 08:02

Also, mortgage completion dates can be set back, repeatedly

They are buying the house they are currently renting.

Well surely you shouldn't have to give the landlord notice, if you are buying the house you are renting? They already know about it!

If they got funny about it you could argue that they should give you notice (seeing as they are selling the house you are renting)

I'd get your solicitor to speak to theirs and get clarification

Changingwiththetimes · 13/04/2021 12:26

I also don't understand the need to give notice. Surely you pay the rent up until you compete, proportionally. This is something you pay your solicitor to deal with.

BrieAndChilli · 13/04/2021 12:56

surely once the house has been sold you become the landlord and so any rent due is payable to yourselves?!!!! so notice period doesnt matter? if he was selling to a new landlord you would pay the new one not the old one

MazekeenSmith · 13/04/2021 12:57

You have to give a clear month notice so it has to be from the rent due date

Oh you're buying the house? Clearly you don't have to give notice then! I would hope you've asked your solicitors to clarify this though?
MadeForThis · 13/04/2021 13:06

There would be no notice due as both parties are involved in the sale.

Landlord doesn't need to give you notice either.

Ineedaneasteregg · 13/04/2021 13:37

Our tenant has just bought our old house.
She did buy on the day before the next months rent was due, completing and exchanging on the same day.
But it would be straightforward to pay pro rata for part of a month.

No notice giving is needed by anyone.

Betty000 · 13/04/2021 13:45

This should be something your conveyancer will deal with, liaising with your sellers.

Betty000 · 13/04/2021 13:46

I mean with regards to the proportional rent due

Thank you all, we weren’t quite sure on what the process is. I didn’t know if we legally have to give notice that’s all Flowers
