Right to photos EA question

I have been searching everywhere for the answer to this question. Sorry if it has been asked many times already.

We are about to instruct an EA 1% commission. We have to pay £100 for photos with a professional photographer instructed by the EA

I have been looking in the T&C’s to find out whether we would ‘own’ the photos if we were to change our minds or cancel the EA

Does anyone know?

I hope that makes sense. I’m very tired!

I've never heard of this before! The cost of the photos should be included in the 1%. I'd shop around if I were you

Nope definitely not a mansion 😉.
I feel like it was a standard thing with all 5 of the estate agents we had around.

The tick box says ‘additional marketing fees’
So I wonder whether if we said no they’d do their own. I think I’ll need to clarify this.

Not an online one.

They appear to be the most popular EA in our house search.
They are selling the house we really want so are trying to make ourselves look the best buyers.

On the inclusion bit - I’ve recently had quotes from two EAs who both have 1% fees and photos are included in the price.

I think Copyright will automatically go to the photographer/employer/EA, you need the intellectual property to be covered in the contract stating who is the owner for you to be the copyright owner. It could just be an email passing the ownership to you if you want to make it a condition of you signing up to them.

We paid £80 for photos, I just copied and pasted them from Rightmove and gave to the new agent they were good enough quality, possibly not legal but they weren't likely to chase. I regret going with them in first place.

Some agents do charge for photos but ive known vendors take them with them if they move to another agent as they have paid for them. I would ask the estate agent.

In my experience agents that dont charge extra normally take the photos themselves so they arent as good as professional ones. Look up the agents other properties on rightmove to see what other properties look like.

I went with a sole agency and had to pay for a photographer to come round to photograph my house, he was fantastic and worth every penny. I kept the photos and was able to use them when I sacked the first agent :)

We paid for photos and a video tour. Just to add, you don't own the photos. If you change agents you will need new photos to be done

We didn't pay for photos when we sold our last home over 10 yrs ago, it was included in the price. Our buyer was a private landlord and a huge pain, he continues to use the photos from our house sale whenever he needs new tenants. We did ask the EA to stop using "our" photos and were told we had no ownership of the images.
