Deed of Trust

Hi,

I am currently in the middle of a remortgage, which involves removing an ex partner & adding my Fiancé. I understand we can do a deed of trust, regarding the money side of who contributed what. However I'm not sure if this is possible, but does anyone know if there is a way I can ensure if we were to split, I could stay in the house with our child (2 years old). I obviously hope this does not happen, but as I previously been through a breakup with a mortgage, I was wondering if this is possible. He has verbally said he has no problem with leaving the house & staying on the mortgage ( I could not buy him out) & I would remain in the home with our child. But is there a way to make this legal?

We got a deed of trust drawn up when we bought our house, all very straightforward explaining what would happen in the event we split up. If you’re marrying him though you might want to check if that makes it null and void as that was mentioned at the end of our document.

You choose to own the house as Tenants In Common rather than Joint Tenants.

The solicitor does you a deed of trust that stipulates the conditions. I.e what proportion of equity you will own.

You need to talk to a solicitor before you do anything.
