Bought house, handing notice in on rental, bit worried

Due to get keys next week once everything has (hopefully) been sorted.

We're renting. We were initially planning on staying until next year before we saw this place. When we first saw the flat the agent asked how long we were planning on staying, we said 6 months and he said the landlord was looking for someone to stay for 9 months but we got it anyway.

So we'll only have stayed 3 months by the time the notice is handed in. There is nothing in the contract that stipulates a duration of tenancy that we're tied to, only that 28 days' notice is required if you want to leave. Still a bit nervous that they will try and get more money out of us and dreading handing in notice. But surely others might leave early too, if there's awful neighbour noise or change of job location etc? Just want some reassurance. Thanks.

Have you double checked that? It would be very unusual for no minimum term to be defined. Also consider your email trail and what the intent was within the email chat

TheyPavedParadise · 02/12/2020 13:09

Are you sure there wasn’t a minimum term?
We have rented a lot and have never started on a rolling monthly contract, there has always been an initial minimum term.

Are you in England? It's extremely likely that there will be a minimum term and you can serve notice to bring the tenancy to an end after that rather than being able to end it at any time.

I'm in Scotland, found this online:

scotland.shelter.org.uk/get_advice/advice_topics/renting_rights/ending_a_tenancy#:~:text=If%20you%20want%20to%20end,long%20it%20is%20in%20writing.

So maybe it falls under the private residential tenancies part? I've read my emails over and there's nothing mentioned about contract periods there either.

Your link @WTF0ver also states

'Your tenancy agreement should say whether or not you can end your tenancy before the fixed term is up, and how much notice you need to give. If your tenancy agreement doesn't mention this, you may find your landlord can still charge you rent until the fixed term is over, even if you need to move out before this.'

I would think it highly unusual that you signed a rolling tenancy from the off.
What does your contract read?

Ecthelion · 02/12/2020 14:41

There's no minimum contract period in Scotland under the new Private Residential Tenancy agreement any more so you should be fine.

Something else Scotland do better than England then! It feels as though their house sales and renting practices are far superior to England versions, less stress all round.

Also, sorry to OP, I assumed you were in England

Thanks everyone for your help. Just trying to find a template online that I can use as a letter.

Yes the buying and selling rules up here seem a lot better, no gazumping! This is my first time renting so I've been super nervous, creeping around like a mouse hoping the neighbours don't hear and constantly worrying about breaking things!
